This is a request under the Freedom of Information Act. I hereby request the following records:

With respect to US Fish and Wildlife law enforcement operations based in Region 4:
-The current memorandum of agreement (MOA) or memorandum of understanding (MOU) with the Defense Logistics Agency, Disposition Services regarding the 1033 equipment surplus program administered by the DLA Law Enforcement Support Office
-A roster/inventory of all requests to the Pentagon's Program 1033. If a roster is not available, please provide copies of all applications.
-A roster/inventory of all items received from the 1033 program.

I also request that, if appropriate, fees be waived as I believe this request is in the public interest. The requested documents will be made available to the general public free of charge as part of the public information service at MuckRock.com, processed by a representative of the news media/press and is made in the process of news gathering and not for commercial usage.

In the event that fees cannot be waived, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 20 business days, as the statute requires.

This is in response to your Freedom of Information Act (FOIA) request
dated September
10, 2014, seeking information regarding the 1033 equipment surplus program.

The Southeast Region Refuges Law Enforcement Office has reviewed their
files. In accordance with 43 CFR 2, attached is all pertinent information
that we found in these files. After reviewing our files it was determined
that our Refuges Law Enforcement Office does not have any documents
pertaining to a MOU or MOA.

Our Headquarters Office of Law Enforcement are currently reviewing their
files and will respond directly to you concerning any additional documents
pertaining to this request.

Should you consider any parts of this response to be a denial, you may
appeal this to the FOIA Appeals Officer. The FOIA Appeals Officer must
receive your FOIA appeal no later than 30 workdays from the date of this
final letter responding to your FOIA request. Appeals arriving or
delivered after 5 p.m. E.T., Monday through Friday, will be deemed received
on the next workday. Your appeal must be in writing and addressed to:

limited to those records that are subject to the requirements of the FOIA.

should not be taken as an indication that excluded records do, or do not,
exist.
