This is an EXPEDITED request under the Freedom of Information Act. I hereby request the following records:

The following three documents for each 1033 state coordinator:

-The current memorandum of agreement (MOA) or memorandum of understanding (MOU) with the Defense Logistics Agency, Disposition Services regarding the 1033 equipment surplus program administered by the DLA Law Enforcement Support Office.

-The equipment inventory form required to be completed on an annual basis by each state coordinator of the 1033 program, including all attachments.

-All Program Compliance Reviews completed. Per DLAI 8160.01, this is to be done on a bi-annual basis.

This is an EXPEDITED FOIA request in light of the considerable media coverage of the 1033 program surrounding the ongoing situation in Ferguson, MO. In support of my request for EXPEDITED processing, please note the intense public and Congressional interest in the 1033 program, as evidenced by considerable media coverage as well as the introduction of at least one bill to modify the 1033 program.

In further support of my request for expedited processing, please note that I am a journalist with considerable experience covering law enforcement, and specifically law enforcement equipment. My ongoing series on unmanned aerial vehicles (motherboard.vice.com/tag/The+Drone+Census) has garnered nationwide attention for my thorough examination of UAVs as acquired by government agencies across the country. Via MuckRock and extensive freelance relationships, I have a number of outlets for the dissemination of not only the data I request above, but also unique media content that employs editorial skill to distill complex governance matters to a wide audience.

I also request that, if appropriate, fees be waived as I believe this request is in the public interest. The requested documents will be made available to the general public free of charge as part of the public information service at MuckRock.com, processed by a representative of the news media/press and is made in the process of news gathering and not for commercial usage.

In the event that fees cannot be waived, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you again for speaking on the phone with me earlier. My language regarding all three components of this request, including the second component regarding the annual inventory certifications comes from a number of MOAs I received directly from 1033 state coordinators.

From Section VI of the above MOA, "Annual Inventory Requirement":

A. Per the DLA I 1111 and the DLA MOA between DLA and the State, each State is
required to conduct an annual inventOry certi?cation of controlled property.

C. The State Shall:

3. Validate and certify the accountability of all controlled property received through the LESO Program annually with each LEA, by having them conduct and certify a physical inventory. State Coordinators must adhere to additional annual certification
requirements as identified by the DLA Disposition Services LESO. All inventories and certification statements will be maintained on file indefinitely.

a. The DLA Disposition Services LESO requires each State Coordinator to
submit certified inventories for their entire State by January 3 of each year.
The Fiscal Year (FY) is defined as October 1 through September 30 of each
year. This gives the LEAs three months to physically inventory LESO Program
property in their possession, and submit their certified inventories to their State
Coordinators.

b. In addition to the certified inventories, the DLA Disposition Services LESO
requires photographs for all Aircraft, Watercraft and Tactical Vehicles, and
Weapons received through the LESO Program.

c. States that fail to submit the certified annual inventory by January 31st, may
be suspended from operations within the LESO Program. Further failure to
submit the certified annual inventory may result in a state termination.

Per the above, I would ask for confirmation that the database you were referring to is the same as the annual inventory certification I have requested here.

Dear Shawn,

The system we discussed is used by the LESO office for more than just the State Inventory Certification. The system contains the inventory of the LEAs. This inventory is verified by the state coordinator electronically, in lieu of using a standardized Equipment Inventory Paper Form. The verification is just one element of the data in the system. The LESO Active Inventory data recorded in this system is displayed in the eFOIA Reading Room, further broken down by General items and Tactical items as determined to be publically releasable.

In essence, a request for the database inventory would result in what is already posted in the eFOIA reading room.

1) Would it help to narrow the request simply to the verification statement submitted by each state coordinator, or summary of all such verifications, from the LESO system?

2) If what I'm requesting here is restricted to what is already releasable, it's unclear to me how the redaction of agency name for tactical items is as involved as you described last week — was the data posted to the eFOIA reading room redacted manually via the process you described in our phone call?

Yes, each state must have a PCR done every two years.
