Re: Open Public Records Act (OPRA) Request(s) Acknowledgment

This office received your OPRA request for “all contracts (and their amendments) and memorandums of understanding entered into by Union County, New Jersey for services and activities related to the Elizabeth Detention Center” on January 2, 2015. The OPRA law requires that a response be provided within seven (7) business days, beginning the first business day after receipt of the request. We will have a response prepared by January 13, 2015. We will contact you and provide a page count and price, should you wish to purchase any copies. You also have the option of viewing the records in the Clerk of the Board’s office. If the records are available electronically, they can be provided via email if preferred. There is no charge for email or to inspect a document.

Pursuant to Ordinance 710-2010, adopted on October 14, 2010, the following fee schedule applies for photocopies: first page to tenth page: no charge; eleventh page and every page thereafter: $.05 per page for documents that are letter-sized or smaller, and $.07 per page for documents that are legal-sized or larger. There shall be a limit of thirty (30) pages forwarded via facsimile to any requestor, per request, and the fee schedule is as follows: first page to tenth page: no charge; eleventh page to thirtieth page: $.05 per page for letter-sized documents, and $.07 per page for legal-sized documents.

If you wish to have records mailed or faxed to you, we kindly ask that you remit payment to the following address:

Office of the Clerk of the Board
Union County Administration Building – 6th Floor
10 Elizabethtown Plaza, Elizabeth, NJ 07207

Please do not send cash; kindly make a check or money order payable to the County of Union. We will provide the documents upon receipt of payment. If no information is available, or falls under a category protected by law, our response will provide an explanation.

OPRA ordinarily grants immediate access to budgets, bills, vouchers, contracts (including collective negotiations agreements and individual employment contracts), and public employee salary and overtime information. However, it may take longer to complete requests for immediately accessible documents depending on the amount of material requested, medium requested, if redaction is required, or if records are in storage. For all other records: documents stored in archive, those that require redaction as provided by law, or requests that require an extensive amount of work to complete may take longer than seven (7) business days to compile.

In accordance with the OPRA, requests that require an extensive amount of effort to complete may be subject to a special service charge in addition to the statutory per-page fees. Special service fees, if applicable, are determined on a case-by-case basis and you will be informed of the charge prior to it being incurred. The archive fee is $2.00 per box—in addition to the statutory per-page copy fees—and you will be informed of any fees prior to the charge being incurred. Please be advised that work on such requests will not begin until receipt of the special service charge and/or archive fees.

If your OPRA request is denied, you have a right to appeal the decision. You may take your appeal to the New Jersey Government Records Council (GRC) or the New Jersey Superior Court, as provided by N.J.S.A. 47:1A-6 and 7. For additional information on the appeal process, please visit: http://www.nj.gov/grc/register/appeal/.

We thank you in advance for your anticipated cooperation and patience while we work to fill your request. If you have any questions, please call this office at (908) 527-4178 or (908) 527-4157.
