Re: Open Public Records Act (OPRA) Request(s) Acknowledgment

This office received your OPRA request for data regarding cases of missing American Indian/Alaska Native persons, including juveniles, from 2000-2021 on June 16, 2021. OPRA requires that a response be provided within 7 business days, beginning the first business day after receipt of the request. We will have a response prepared by June 25, 2021. Records are typically provided to requestors in electronic format, for which there is usually no cost (see below for additional information). However, the County will advise you of the page count and cost, if you wish to buy paper copies. You may also review documents at no cost in the Clerk of the Board's Office; if you choose this option, please call or email ahead to arrange a mutually convenient appointment.

Pursuant to Ordinance 710-2010, adopted on October 14, 2010, the following fee schedule applies for photocopies: pages 1-10: no charge; page 11 and each page thereafter: $.05 per page for documents that are letter-sized or smaller, and $.07 per page for documents that are legal-sized or larger. There shall be a limit of 30 pages forwarded via facsimile to any requestor, per request. The fee schedule is as follows: pages 1-10: no charge; pages 11-30: $.05 per page for letter-sized documents, and $.07 per page for legal-sized documents.

If you wish to have records mailed or faxed to you and there is a cost for same, please send your payment to the following address:

Office of the Clerk of the Board
Union County Administration Building - 6th Floor
10 Elizabethtown Plaza
Elizabeth, NJ 07207

Please do not send cash; kindly make a check or money order payable to the County of Union. We will provide the documents upon receipt of payment.

OPRA ordinarily grants immediate access to budgets, bills, vouchers, contracts (including collective negotiations agreements and individual employment contracts), and public employee salary and overtime information. While the County makes every effort to provide immediate access to such documents, processing may take longer depending on the amount of records requested, medium requested, if redaction is required or documents are in storage, or if the request requires extensive work to complete. The same is true for requests for non-immediate access documents. When additional time is needed to process a request, the County provides requestors with written updates accordingly.

In accordance with OPRA, requests that require extensive work to complete may be subject to a special service charge in addition to applicable copy fees and/or archive fees ($2/box). Special service fees are determined on a case-by-case basis; you will be informed of same before incurring the charge. Please be advised that work on such requests will not begin until receipt of the special service charge and/or archive fees.

If no records are available, or the record(s) are exempt in accordance with OPRA, the County will advise accordingly.

If your OPRA request is denied, you have a right to appeal the decision. You may file your appeal with the New Jersey Government Records Council (GRC) or the New Jersey Superior Court, as provided by N.J.S.A. 47:1A-6 and 7. For additional information on the appeal process, please visit: http://www.nj.gov/grc/register/appeal/.

Thank you in advance for your anticipated cooperation and patience while we work to fulfill your request. If you have any questions, please call this office at (908) 527-4178 or (908) 527-4157.

Thank you for replying back to our OPRA request,

We have a few follow up questions:
1. Do you keep records of missing cases in your jurisdiction?
2. Do you keep these records based on race/ethnicity, gender, age, and/or other demographic characteristics?
3. If you do not have any records pertaining to missing Native Americans/Alaska Natives, do you have any records of murdered Native America/Alaska Natives in file in your jurisdiction?

Thank you in advance for your anticipated participation in the matter.

Sincerely,

Urban Indigenous Collective
