Pursuant to the state open records law, Ariz. Rev. Stat. Ann. Secs. 39-121 to 39-122 and 39-128, I hereby request the following records:

A list or log of U.S. Immigration and Customs Enforcement referrals made by the Tucson Police Department since January 2009 grouped by month, year, and reason for arrest, reason for referral, and whether ICE took custody of the arrestee or not. If no such log is kept, please perform a word search on the police reporting system, using keywords: Immigration, ICE and detainer, and provide copies of records that indicate a referral was made to ICE.

I also request that, if appropriate, fees be waived as I believe this request is in the public interest. The requested documents will be made available to the general public free of charge as part of the public information service at MuckRock.com, processed by a representative of the news media/press and is made in the process of news gathering and not for commercial usage.

In the event that fees cannot be waived, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I would request your response within ten (10) business days.

My name is Sergeant Chris Widmer with the Tucson Police Department. Our agency received a FOIA request from MuckRock.com on January 29, 2014. It was authored by Dongjae Jung. The request was initially sent to our Records Department but has since been sent to me in the Public Information Office for follow up. I've reviewed your request and looked into what information I can retrieve. There are parts of your request that we have readily available to send to you and parts of your requests that we cannot fulfill as we do no track that type of information.
