• All email communications, text messages, calendar entries (including, but not limited to any personal journals/books containing notes/dates or other material) maintained, created or maintained for Chancellor William McRaven and/or his personal assistant for the period beginning Feb. 3, 2015 to the present.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that fees cannot be waived, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 10 business days, as the statute requires.

Dear Ms. Lipton,

This correspondence is in response to your below email responding to System's December 18, 2015 request for clarification of your December 7, 2015 request.

Although you offer "to review the display 'headers' of the emails of both individuals" in order to "identify the specific emails to be produced (or to be considered . . . for redaction . . . )," because we are still required, by law, to review information for confidentiality prior to its release, this approach will not reduce the amount of correspondence System will be required to review prior to providing such a list to you. Moreover, this method would require System to create a document with the email headers or to redact the other information from the emails at issue, which itself would require additional time subject to allowable charges. Additionally, some of the email headers may be contained within communications subject to attorney-client privilege or communications that may be confidential in their entirety under the law, and therefore could not be provided to you for review.

As your proposal would not narrow the scope of your original request, our original request for clarification, attached for reference, still stands. Please let us know whether you continue to seek the entirety of the email correspondence and calendar entries requested or if you would like to narrow your request. To the extent you wish to proceed with your request for all listed email correspondence and calendars, we will provide a cost estimate for your request in accordance with the allowable charges.
