Dear Mr. Lipton:

The University of Texas at Austin advised you on October 9, 2015 to redirect your Open Records Request to the state agency that maintains the documents you are requesting. You responded and indicted that your request was “meant to encompass the University of Texas system. If it should be directed to another office, provision of the appropriate contact information would be appreciated.”
UT Austin is only responsible for responding to requests for records that we maintain in our custody and control. The University of Texas System is a state agency separate and apart from UT Austin. Chancellor McRaven is an employee at UT System. Once again, please redirect your request as per our earlier instructions (below) dated October 9, 2015.

Please feel free to contact me directly at (512) 471-8300 if you require any further assistance.

To Whom It May Concern:

Thank you for your letter requesting clarification.

In an effort to possibly reduce the scope of the email portion of the request, we are willing to review the display ‘headers’ of the emails of both individuals. We will then identify the specific emails to be produced (or to be considered by you for redaction, etc.).

In the meantime, please let us know your timetable on producing the non-electronic portions of our request (books/journals, etc.). Please confirm your receipt of this email.

Thank you.

Re: Public Information Request to The University of Texas System Administration - OGC ID No. 166475

Dear Ms. Lipton,

This correspondence is in response to your below email responding to System's December 18, 2015 request for clarification of your December 7, 2015 request.

Although you offer "to review the display 'headers' of the emails of both individuals" in order to "identify the specific emails to be produced (or to be considered . . . for redaction . . . )," because we are still required, by law, to review information for confidentiality prior to its release, this approach will not reduce the amount of correspondence System will be required to review prior to providing such a list to you. Moreover, this method would require System to create a document with the email headers or to redact the other information from the emails at issue, which itself would require additional time subject to allowable charges. Additionally, some of the email headers may be contained within communications subject to attorney-client privilege or communications that may be confidential in their entirety under the law, and therefore could not be provided to you for review.

As your proposal would not narrow the scope of your original request, our original request for clarification, attached for reference, still stands. Please let us know whether you continue to seek the entirety of the email correspondence and calendar entries requested or if you would like to narrow your request. To the extent you wish to proceed with your request for all listed email correspondence and calendars, we will provide a cost estimate for your request in accordance with the allowable charges.

Please let me know if you have any questions or give me a call if you would like to discuss the request via phone.
Regards,
Cynthia

Hello Ms. Tynan,

Thank you so much for your message. I understand the disruption that such a request might cause, and I'm wondering whether it would be possible for your office to provide two separate estimates: one for the entirety of the request and one for the collection and review of only those emails sent to Chancellor McRaven.

Thanks again for your help and patience with this request.

Best wishes,
Beryl

From: Tynan, Cynthia

Ms. Lipton,

Attached, please find the requested cost estimate, which includes both an estimate for the entirety of the requested information and an estimate for information pertaining only to the Chancellor.

Cynthia
