Pursuant to the { Texas Freedom of Information Act. }, I hereby request the following records:

- A copy of any and all contracts (including associated amendments and exhibits) awarded to Pepsi, Coca-Cola, or any subdivision thereof, for the provision of beverages or other goods in any facilities under the purview of this organization, including all activities and buildings associated with athletics, sports, dining services, or otherwise. If this agency does not have a contract with either of the named companies, please provide the equivalent agreement with the currently employed company.
- If the contract(s) was cancelled, any and all materials related to its cancellation.
- If the contract was cancelled, the statement from the university about cancellation.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

What happens after you submit a Request? Tarrant County College District will respond to open records requests in the order that they are received. We are required to promptly release the information that is not confidential or that does not fall within one of the exceptions. The Public Information Act allows agencies up to ten (10) business days to respond to your request. The response could be that (1) we release parts or all the records, (2) we have no records responsive to your request, (3) clarification is needed, (4) we have estimated charges, (5) we believe the records are confidential and have requested the OAG for a ruling on the records, or (6) we need additional time to locate, compile, or manipulate the data/records. . Please note that Tarrant County College will produce the results for production of documents at one time. In regards to your specific request, I anticipate a response to you on or before 02/08/23.
Please be aware that records rarely exist in just one place. Several parts of the College District and a number of different employees may need to locate and compile responsive records. Sometimes we must resolve questions about the request before we begin locating the responsive documents. Keep in mind that it may take longer to locate, compile, and redact all records, especially when a request is large in scope.

What does it cost to receive public information?
The permissible charges for public information may be found at 1 TAC Part 3 §70.1 et seq. In general, if the number of copies in your request is 50 or less, the charge will be $0.10 per page plus the cost of postage (or other delivery method, at your request); if more than 50 pages, the charge will be $0.10 per page plus personnel costs necessary to compile the documents at a rate of $15.00 per hour, in addition to the charge for postage. We do not ask for payment if the total of charges is less than $10.00. We may alter this general rule in certain circumstances, although typically not by a significant amount. If you are concerned about the cost of a request, please feel free to contact Open Records at 817-515-5444.
If the estimated cost of fulfilling your request exceeds $40.00, we will provide you with an itemized written statement of the cost. You must respond in writing within 10 business days after the date the estimate is sent that you will accept the cost, or that you desire any stated alternative, or your request will be considered withdrawn.

Note: House Bill 2758 Section (e) states: "The personal identifying information obtained from an individual for the purpose of the emergency alert system of an institution of higher education, including an e-mail address or telephone number, is confidential and not subject to disclosure under Section 552.021, Government Code." HB 2758 was signed June 17, 2011 by Governor Perry and effective immediately.

(TX P.I.A. 552.275)

* E. Cost Provisions Regarding Requests Requiring a Large Amount of Personnel

Time Section 552.275 of the Government Code authorizes a governmental body to establish a reasonable limit, not less than 15 hours for a one month period or 36 hours in a 12 month period, on the amount of time that personnel are required to spend producing public information for inspection or copies to a requestor, without recovering the costs attributable to the personnel time related to that requestor.226 If a governmental body chooses to establish a time limit under this section, a requestor will be required to compensate the governmental body for the costs incurred in satisfying subsequent requests once the time limit has been reached.

Please be aware that your request will be considered automatically withdrawn if you do not respond in writing within ten (10) business days of the date of this statement that you: (a) accept the charges, (b) modify your request in response to the estimate, or (c) have sent, or are sending a complaint regarding the charges to the attorney general.
