Pursuant to the Texas Public Information Act, I hereby request the following records:
Information related to:
(A) the two most recent requests for STAR+PLUS HCBS recertification that were initially denied because "the facts in the assessment don't show [the beneficiary] need(s) the level of care that would be provided in a nursing home" but resulted in a Fair Hearing in which the Agency's denial was ultimately OVERRULED by the Hearings Officer.
(B) the two most recent requests for STAR+PLUS HCBS recertification that were initially denied because "the facts in the assessment don't show [the beneficiary] need(s) the level of care that would be provided in a nursing home" but resulted in a Fair Hearing in which the Agency's denial was ultimately SUSTAINED by the Hearings Officer.
Specifically, I am requesting all possible documents related to each of the above four request, including, but not limited to:
(a) all documents submitted in conjunction with the request for recertification;
(b) all documents and forms used to make the recertification determination;
(c) any notes generated by the entity responsible for making recertification decisions;
(d) the denial notice associated with each request;
(e) the Fair Hearing evidence packet sent to the Appellant; and
(f) the final Fair Hearing Decision/order in its entirety.
The beneficiary's name, Medicaid number, Medicaid provider, authorization number, and any other confidential information may be redacted as necessary from the responsive documents to comply with HIPAA and meet the criteria for document disclosure under the Public Information Act, or as otherwise necessary to comply with any relevant state or federal law.
The requested documents will be made available to the general public, and this request is not being made for commercial purposes.
In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.
Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 10 business days, as the statute requires.
