Pursuant to the Texas Public Information Act, I hereby request the following records:
Any records pertaining to any and all teachers who have worked for Grand Prairie ISD schools that were either terminated or resigned under allegations of inappropriate relationships with a student or any criminal activity on a Grand Prairie ISD campus. Please provide the complaints or records that pertain to any incidents on file.
The requested documents will be made available to the general public, and this request is not being made for commercial purposes.
In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.
Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 10 business days, as the statute requires.

Request for Clarification

Dear Malcom Chakery:
On September 11, 2020, the Texas Education Agency (TEA) received your public information request (PIR). A copy of your original request is enclosed. Because your request is unclear or overbroad, please contact our office to provide a clarification or narrowing of your request based on the explanation below.
The Educator Investigations Division and SBEC Enforcement Division records are kept by educator name. We do not electronically track supplemental case information such as the reporting school district and/or Campus, or if an educator has been terminated or resigned in which the alleged violation occurred.
The only document the Agency would receive that might have the type of information you are requesting (if applicable) would be the 249 Superintendent Report. Therefore, we would have to review, search, and locate all our files to determine the reporting district, campus, if the educator terminated or resigned, and if any criminal activity occurred on the campus. This would incur a cost. Educator Investigations began tracking Superintendent 249 Reports effective September 1, 2017. Therefore, we can provide you with the 249-superintendent report, from September 1, 2017 to the present, from the District, which may indicate if the educator was terminated or resigned at the time. This option will most likely not incur a cost.
We can also search for any named individual if you wanted to provide a list of names.
Please clarify if you would like to proceed with the cost estimate, one of the above options, or if you would like to narrow the timeframe.
You may send your clarification by mail, fax, or e-mail. Additionally, you may deliver your clarification in person to our office.

On September 11, 2020, the Texas Education Agency (TEA) received your request for public information. To the extent it exists, the requested information is provided to you with this letter and includes a copy of the original request. Additionally, there are no charges for fulfilling this request and PIR # 44178 is considered closed.
The Educator Investigation Division received the Superintendent report (249) from the School District. Upon review, we determined that this matter did not warrant a formal Investigation. Therefore, an investigation was not opened. Please refer to the Excel attachment.
The responsive data was redacted in accordance with the Texas Public Information Act.
1. The information you requested contains student-level information which have been redacted per FERPA.
Pursuant to the federal Family Educational Rights and Privacy Act of 1974 (FERPA), 20 U.S.C. Section 1232g, TEA is required to withhold from public disclosure personally identifiable non-directory information in education records. Additionally, in Open Records Decision No. 634 (1995), the Texas Attorney General authorizes TEA to withhold any information requested under the Public Information Act that TEA determines is confidential under FERPA without the necessity of seeking a determination from the Attorney General under Section ยง552.301 of the Government Code.
