From: Office of the Governor

Mr. Barrouquere:

This email seeks to narrow or clarify your request to avoid the production of and potential charges for responsive information that you are not interested in receiving. Additionally, clarifying or narrowing the scope of your public information request can assist the OOG in providing responsive information to you more quickly and potentially avoid the need for a decision from the Office of the Attorney General.

Your original request seeks "[all emails, notes, memos, messages and text messages] between of Alliance Defending Freedom, also known as ADF, any employees of the group and the Texas Governor's Office between January 14, 2013 and [January 8, 2019]." Please respond to the following request for clarification or narrowing:

· Are you willing to narrow your request to exclude certain divisions that are not likely to have information related to your request? Narrowing your request to exclude certain divisions, such as the Texas Music Office or Texas Film Commission, may reduce the chargeable labor required to obtain any responsive information. To see a list of some of the divisions of the OOG that may be excluded, you can visit: https://gov.texas.gov/organization.

Your narrowing or clarification of this request does not preclude you from making future requests for additional information. After we receive your response, we can begin a search of our records for the information you are seeking. If the OOG does not receive a response from you by the 61st day after the date this email is sent, your request will be considered withdrawn. See Gov't Code § 552.222(d), (g). The withdrawal of your request does not preclude you from requesting the same or other information in the future. You can reach us at publicrecords@gov.texas.gov<mailto:publicrecords@gov.texas.gov> or 512-463-1750 with any questions.

Mr. Barrouquere,

Thank you for contacting me. The Office of the Governor (“OOG”) has requested a ruling from the Office of the Attorney General (“OAG”) related to this matter. The January 31, 2019, date referenced in my January 23, 2019, email below pertained to the date by which we would provide additional correspondence in relation to your request, not the date we anticipated completing your request.

Mr. Barrouquere,

Thank you for contacting me. As noted in my February 14, 2019, correspondence (attached), the Office of the Governor (“OOG”) has requested a ruling from the Office of the Attorney General (“OAG”) related to this matter. Because the OAG has 45 business days by which to rule on whether information must be withheld, we are not able to give a completion date for this matter because the OAG could rule before or on the 45th business day.

If you would like to contact the OAG to check on the status of that file, you may call the Open Records Hotline at 877-OPEN TEX. Leave a message providing the OOG PIR ID# (011-19), your name, and the date on which the OOG requested a ruling (January 23, 2019) and they will call you back.

Please let me know if you have any further questions.

Mr. Barroquere,

Thank you for your email. We have received a ruling from the Attorney General and are redacting documents in accordance with the direction provided by the Attorney General. Additionally, as a matter of practice, when third parties are involved in the ruling process, we provide them with some time to challenge an Attorney General ruling, should they choose to do so. Once I confirm the third party in this instance does not plan to challenge the Attorney General’s ruling, I will release the information in accordance with that ruling.
