TDLR submitted its final request for a ruling to the Office of the Attorney General (OAG) today. Your copy of our request is attached and uploaded to the TDLR Records Center.

Thank you for your patience while we awaited a response from the Office of the Attorney General (OAG). TDLR received the attached ruling from the OAG and your copy has been uploaded to the TDLR Records Center.
We have determined that complying with your request, and the ruling of the OAG, will result in the imposition of a charge that exceeds $40. Therefore, we are providing you an invoice as required by section 552.2615 of the Texas Government Code.
The estimated charges exceed $100.00; therefore, as allowed by section 552.263(a) of the Government Code, we require a deposit of 100% before any additional work on your request will be undertaken. The Department anticipates that, upon payment received and cleared, the work to comply with the request will be completed not sooner than 10 business days from the date of payment.
Your request will be considered automatically withdrawn if you do not notify us in writing within ten business days from the date of this letter that you either:
* Accept the charges;
* Wish to modify your request; OR
* Have sent to the Open Records Division of the Office of the Attorney General a complaint alleging that you are being overcharged for the information you have requested.

You may pay online by selecting here to be directed to the TDLR Public Records Center. If you accept the charges your payment must be received before any documents are produced. If you pre-pay and the actual final amount is less than the amount paid, you will be issued a refund by separate cover. If the actual amount is more than what you paid but within 20% of that amount, payment must be made in full before you can receive the requested documents. An updated statement will be sent to you if the final amount exceeds 20% of the first agreed estimated amount.
There is a not a less expensive way for you to obtain this information. The costs associated with this request are the labor hours TDLR personnel have expended or will expend to locate, compile, and make the information available for release to the public.
For more information, regarding this cost estimate, please Section 552.263 of the Texas Government Code, which reads in part:
(e) For purposes of Subchapters F and G, a request for a copy of public information is considered to have been received by a governmental body on the date the governmental body receives the deposit or bond for payment of anticipated costs or unpaid amounts if the governmental body's officer for public information or the officer's agent requires a deposit or bond in accordance with this section.
(e-1) If a requestor modifies the request in response to the requirement of a deposit or bond authorized by this section, the modified request is considered a separate request for the purposes of this chapter and is considered received on the date the governmental body receives the written modified request.
(f) A requestor who fails to make a deposit or post a bond required under Subsection (a) before the 10th business day after the date the deposit or bond is required is considered to have withdrawn the request for the copy of the public information that precipitated the requirement of the deposit or bond.
