Pursuant to the Texas Public Information Act, I hereby request the following records:

memos, reports, annual reports, etc. that give statistics on the fees generated by police tickets. I am specifically interested in how this has changed from previous years due to Covid 19.

If possible, the statistics broken down by city, county, or police station would be helpful.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Dear John Ricker:

The Texas Comptroller of Public Accounts received your
request for information.  Your request has been assigned ID# 17782 by this office. You asked for:
Pursuant to the Texas Public Information Act, I hereby request the following
records:

memos, reports, annual reports, etc. that give statistics on the fees
generated by police tickets. I am specifically interested in how this has
changed from previous years due to Covid 19.

We do not have the data required to provide the requested data. 
Information reported to us on Quarterly
report forms (State Criminal Costs & Fees – city form #40-144, cnty
#40-145) includes the lump sum of all collections of state court costs in a
city or county from all its courts (justice, county & district courts). Court
costs are assessed on the conviction of any offense so the reported totals
include not only non-traffic related offenses but municipal ordinances as well.

There is a “state traffic fine” (TRANS. CODE Sec. 542.4031.
STATE TRAFFIC FINE )that’s assessed on convictions under
Title 7, Rules of the Road offenses – which would indicate traffic related
offenses – however, since the courts continue to collect on offenses from years
ago this figure does not accurately reflect the pattern for the time period of
the reported quarter. The most recent such report was 1 st Qtr 2020 (reporting
their collections from January – March); the impact of Covid-19 was only at the very end of this reporting period.
Next quarter’s (April – June collections) aren’t due until July 31 st
and won’t be available until August.

The Office of Court Administration may be of value in your
research. It receives monthly
court activity reports from cities & counties. Their reports don’t address collections,
rather they break down court activity (e.g. filed, dismissed, convictions, etc.).
It may breakout what’s traffic related and if so might show monthly trends in
citations during the Covid-19 period.
