Pursuant to Tennessee's Public Records Act, I hereby request the following records:

Document showing victim compensation applications for calendar year 2012, denials for calendar year 2012, as well as disbursement of awarded funds for calendar year 2012 by Zip Code, County and Gender, with dollar amounts.

I also request that, if appropriate, fees be waived as I believe this request is in the public interest. The requested documents will be made available to the general public free of charge as part of the public information service at MuckRock.com, processed by a representative of the news media/press and is made in the process of news gathering and not for commercial usage.

In the event that fees cannot be waived, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 7 business days, as the statute requires.

Additionally, if you require proof of my Tennessee citizenship, please let me know what format of proof is acceptable (i.e., a scanned Driver's License), and how it should be sent.

I am in receipt of your May 24, 2014 public records request in the email below. In Tennessee, records are only required to be made available pursuant to a public records request if the requestor is a Tennessee citizen pursuant to Tenn. Code Ann. §10-7-503(a)(2)(A). Would you be able to provide proof of Tennessee citizenship so that I may continue processing this request?

To the extent that we receive sufficient proof of Tennessee citizenship, the following law applies:

Tenn. Code Ann. §10-7-503 provides the following:

(a)(2)(B) The custodian of a public record or the custodian’s designee shall promptly make available for inspection any public record not specifically exempt from disclosure. In the event it is not practicable for the record to be promptly available for inspection, the custodian shall, within seven (7) business days:
(i) Make the information available to the requestor;
(ii) Deny the request in writing or by completing a records request response form developed by the office of open records counsel. The response shall include the basis for the denial; or
(iii) Furnish the requestor a completed records request response form developed by the office of open records counsel stating the time reasonably necessary to produce the record or information.

Upon receipt of proof of the requestor’s Tennessee citizenship, this office will begin the process of retrieving, reviewing and/or redacting the requested records. In accordance with the above-cited law, this email is being sent to you to inform you that within seven (7) business days after this office’s receipt of proof of the requestor’s Tennessee citizenship, either the records you have requested to inspect/receive copies of will be available or determination of accessibility and availability will be made regarding the requested records.

Relative to your request for documents showing victim compensation applications for calendar year 2012 and denials for calendar year 2012, are you looking for the number of those applications filed and the number of denials for the 2012 calendar year? Relative to your request for the disbursement of awarded funds for calendar year 2012 by Zip Code, County and Gender, with dollar amounts, we will be able to produce that report by June 16th. If you are looking for specific claims for calendar year 2012 as opposed to all funds disbursed for calendar year 2012, please let us know and we can respond accordingly. Thank you.

Thank you for your help. I'm looking for a list of claims for calendar year 2012, not an aggregated total of applications and denials. If you have this data exportable, it could be separated out claims by a unique, non-personally identifiable numerical ID, i.e. 1, 2, 3, 4, etc.

I am not requesting specific claims. For calendar year 2012 I am requesting an export or or other report showing, for each claim filed and denied, zip code, county, gender, amount awarded, claim type and when applicable, denial.

This export could be divided into 2 spreadsheets: One for awards and the other for denials. I'm requesting that both be in list form showing zip code, county, gender and amount awarded for each claim.

Thank you for the clarification. In light of your last email, I have conferred with Department staff and we will be able to provide all of the reports that you have requested by June 25th. We will not produce the one report on June 16th (as indicated in the email string below), but will produce all of the reports requested at once on June 25th.

I have a few more questions attempting to clarify the data that you are requesting; I have received these questions from our IS Department that is attempting to fulfill the request. In your request, you asked for each claim filed or denied in calendar year 2012. For some of the claims filed in 2012 that were awarded, the award may not have occurred in calendar year 2012. Similarly, for those claims denied, the denial may not have occurred in calendar year 2012. Are you looking for the date of award and the date of denial even if it is outside of calendar year 2012, yet filed in calendar year 2012? Also, in your request for "claim type" are you looking for the type of crime. Please let me know as soon as possible so that we can make our June 25th date of producing the report to you. Thank you.

-- For claims filed in 2012 and denied, please include the denial date even when it falls outside that calendar or fiscal year.
-- For "claim type," I am looking for the categories Tenn. uses to classify the type of crime for which the claim is being awarded or denied.
