Pursuant to the Tennessee Public Records Act, I hereby request the following records:

All text messages sent to and from the Secretary of State Division of Election's "Text to Report Voter Fraud" system (https://www.localmemphis.com/article/news/politics/text-concerns-voter-fraud-reports-tennessee-secretary-of-states-division-elections/522-5487547e-9622-4dfb-97fb-7024c996ba78).

Responsive documents should include timestamps, any metadata associated with the text message, as well as the content of the message.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Mr. Hoover:

We received your public records request dated September 21, 2022.

The Tennessee Public Records Act contemplates that a Tennessee citizen may issue a request for specific records from some governmental entities in the state. Consistent with the Tennessee Public Records Act, including Tenn. Code Ann. ยง 10-7-503(a)(2)(A), and the Public Records Policy for the Department of State, an individual seeking records from the Department of State under a public records request must show proof of Tennessee citizenship by providing a copy of a Tennessee driver license or other acceptable form of identification showing Tennessee citizenship. Proof of citizenship is a precondition to inspecting or receiving copies of public records under a public records request. Because no proof of Tennessee citizenship was provided as part of the request, we deny the request.

We will, of course, review any public records request that you may submit or resubmit that includes a copy of your Tennessee driver license.
