Dear Sir / Madam,

I am writing to ask for your help with a request under the Tennessee Open Records Law, Tenn. Code sec 10-7 and 10-8.

Would it be possible for you to send me a copy of any records that would show some or all of the following information:

1. A list of ALL types of alternative asset investments, including private equity, venture capital, distressed debt, mezzanine, fund of funds, infrastructure, natural resources, real estate and private debt partnerships in which Tennessee Consolidated Retirement System is an investor; and
2. For each partnership, may I please have a copy of any alternative assets investment records that would show some or all of the following information:

a. Tennessee Consolidated Retirement System's total commitment to the partnership,
b. the total contributions made by Tennessee Consolidated Retirement System to the partnership to date,
c. the total distributions received by Tennessee Consolidated Retirement System from the partnership to date,
d. the estimated current value of Tennessee Consolidated Retirement System's holding in the partnership, and
e. any available estimates of the IRR earned by Tennessee Consolidated Retirement System to date on its investment in the partnership.

Thank you very much for your attention to this request. For your convenience, I have attached an example of the type of information I am hoping to receive.

In the event that Tennessee Consolidated Retirement System has no such investments, a simple note to this effect will suffice.

To whom it may concern,

I am in receipt of your public records request received by this office. In Tennessee, records are only required to be made available pursuant to a public records request if the requestor is a Tennessee citizen pursuant to Tenn. Code Ann. § 10-7-503(a)(2)(A). Would you be able to provide proof of Tennessee citizenship so that I may continue processing this request?

To the extent that we receive sufficient proof of Tennessee citizenship, the following law applies:

Tenn. Code Ann. § 10-7-503(a) provides the following:

(a)(2)(B) The custodian of a public record or the custodian's designee shall promptly make available for inspection any public record not specifically exempt from disclosure. In the event it is not practicable for the record to be promptly available for inspection, the custodian shall, within seven (7) business days:

(i) Make the information available to the requestor;
(ii) Deny the request in writing or by completing a records request response form developed by the office of open records counsel. The response shall include the basis for the denial; or
(iii) Furnish the requestor a completed records request response form developed by the office of open records counsel stating the time reasonably necessary to produce the record or information.

Upon receipt of proof of the requestor's Tennessee citizenship, this office will begin the process of retrieving, reviewing and/or redacting the requested records. In accordance with the above-cited law, this email is being sent to you to inform you that within seven (7) business days after this office's receipt of proof of the requestor's Tennessee citizenship, either the records you have requested to inspect/receive copies of will be available or determination of accessibility and availability will be made regarding the requested records.

Note that the attached records are as of December 31, 2018 (the most recent date for which these records are maintained) and have been redacted pursuant to Tenn. Code Ann. Section 8-37-104(a)(10(B)). Also, I can confirm that TCRS currently invests in private equity (which includes venture capital, natural resources and private debt), strategic lending, and real estate.
