Pursuant to the Tennessee Public Records Act, I hereby request the following records:
All current operating manuals, user guides, and internal training materials for the Tennessee Highway Patrol's use of Forensic Logic software.
The requested documents will be made available to the general public, and this request is not being made for commercial purposes.
In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.
Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 7 business days, as the statute requires.

Tennessee Code Annotated § 10-7-503(a)(2)(A) provides the following:
“All state, county and municipal records shall, at all times during business hours, for public hospitals shall be during the business hours of their administrative offices, be open for personal inspection by any citizen of this state, and those in charge of the records shall not refuse such right of inspection to any citizen, unless otherwise provided by state law.”
[emphasis added]. See also McBurney v. Young, 133 S. Ct. 1709, 81 USLW 4276 (U.S. Supreme Court April 29, 2013). As such, your request is denied.
Further, this Department received the attached records requests from you on January 24, 2023, another on January 25, 2023, and finally a third on January 30, 2023. The request you reference below has not been previously submitted. If you believe this to be in error, please attach or forward the email you sent from January 21, 2023.

Can you please clarify the explanation for the denial?
If I understand the language of the Tennessee Code that you cited, the denial is because records from public agencies, including hospitals, shall be made available to the public?

No. In the email chain, somehow the bolded text appears unbolded. On our end, the proper formatted does appear. The bolded text was “by any citizen of this state.” The denial was on the basis that you have provided an out of state mailing address and are therefore not a citizen of Tennessee.
