Pursuant to the state open records law, Ariz. Rev. Stat. Ann. Secs. 39-121 to 39-122 and 39-128, I hereby request the following records:

A list or log of U.S. Immigration and Customs Enforcement referrals made by the Tempe Police Department since January 2009 grouped by month, year, and reason for arrest, reason for referral, and whether ICE took custody of the arrestee or not. If no such log is kept, please perform a word search on the police reporting system, using keywords: Immigration, ICE and detainer, and provide copies of records that indicate a referral was made to ICE.

I also request that, if appropriate, fees be waived as I believe this request is in the public interest. The requested documents will be made available to the general public free of charge as part of the public information service at MuckRock.com, processed by a representative of the news media/press and is made in the process of news gathering and not for commercial usage.

In the event that fees cannot be waived, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I would request your response within ten (10) business days.

Hi Mr. Jung,

I have looked into your inquiry and found that Tempe PD does not track ICE holds/referrals that come into our jail. Also, we are not currently tracking ICE referrals in our Records Management System where I am able to pull up this information for you. You may want to reach out to ICE to see if they track how many referrals Tempe has sent to them. If you have further questions please feel free to contact me.

Thank you for your response.
If Tempe PD does not have any electronic system for tracking ICE holds/referrals in the process of law enforcement actions, please tell me how Tempe PD manages and processes data or records on noncitizens with immigration or criminal violation charges.


As you mentioned, I contacted ICE in the past to make similar data requests, but ICE’s data on immigration enforcement policy under federal-local partnerships is very limitedly released, and information about these partnerships, such as 287(g) or Secure Communities, was based on data at the state and county level, not at the city level. As a researcher focusing on immigration policy in terms of intergovernmental level, I need data at the local level on how local law enforcement agencies process immigrant and immigration-related issues.

Like I mentioned in my last e-mail I told you that we do not track the number of ICE holds that come in and out of our jail. That has not changed and I still will not be able to provide you with that data. I am getting our policies that deal with immigration and SB1070 together for you, which you never officially asked for, but I would be more than happy to get to you. I will let you know when it is ready for pick-up.

On March 4, 2014 I sent you our policies and procedures on how we deal with immigration as well as SB107. I am not sure what other documentation you are looking for as I have previously explained that we do not keep records of the number of referrals we send to ICE. Since I have sent you all our documents that we have I will consider your public records request fulfilled.

If there are specific documents that you are looking for please feel free to ask and I will get them to you if we have them.
