Pursuant to the Freedom of Information Act, 5 U.S.C. § 522(“FOIA”), this request is submitted by Morgan Scott, journalist from the Newhouse School of Public Communications at Syracuse. I hereby request the following records in the possession of the Syracuse Police Department Office of Professional Standards:
All law enforcement disciplinary records as defined in Section 86 of the Public Officers Law related or referring to: Officer Dave Craw, Lt. David Hart, Sgt. Matthew Liadka, Officer Kenneth Sheehan and Officer Nicolas Saralegui-Martin, during their time on the force with the Syracuse Police Department.
The requested documents include but are not limited to all complaint records, allegations, and charges against the above, reports related to any incidents involving said names; the name of the employee complained of or charged; the transcript of any disciplinary trial or hearing, including any exhibits introduced at such trial or hearing; the disposition of any disciplinary proceeding; and the final written opinion or memorandum supporting the disposition and discipline imposed including the agency's complete factual findings and its analysis of the conduct and appropriate discipline of the covered employee.
Fee Waiver:
As a journalist, I qualify as “representatives of the news media” and the records are not sought for commercial use. The requesters plan to disseminate the information disclosed as a result of this FOIA request through news media. I also seek a fee waiver because disclosure of these documents is in the public interest, see 5 U.S.C. §§ 552(a)(4)(A)(ii) and 552(a)(4)(A)(iii).
If this request for a waiver is denied, please advise me if fees for complying with this request are expected to exceed $100. If my request is denied in whole or part, I ask that you justify all
deletions by reference to specific exemptions of the FOIA. I expect you to release all segregable portions of otherwise exempt material. I reserve the right to appeal a decision to
withhold any information or to deny a waiver of fees. In the case that the request is deemed 'too burdensome,' I would be grateful if you would inform me by phone at 347-536-4156 so I can resubmit. I would prefer the request filed electronically, by e-mail attachment if available or CD-ROM if not.
Thank you in advance for your anticipated cooperation in this matter. I look forward to hearing from you in writing within twenty working days, as required by the Act.
