Pursuant to the Delaware Freedom of Information Act, I hereby request the following records:

A copy of the current contract between the County and the current vendor for inmate communication services at the County Correctional / Detention Facility. This may encompass telecommunication, kiosk, and mobile tablet services. I am requesting that the information provided contain the term and expiration date of the current contract (including any optional contract extensions), as well as the current telecommunications provider and the services currently being provided pursuant to the agreement.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 15 business days, as the statute requires.

Dear Augie Torres,
Sussex County is in receipt of your public records request, submitted via facsimile after business hours on 4/6/2021. Your request references:
“Communication services contract”.
The County has reviewed its files and has determined there are either no responsive documents to your request, or the records requested are not within Sussex County’s custody.
Please be advised, the Sussex County Sheriff's Office does not function as a law‐enforcement agency; rather, sheriffs in Delaware perform civil and administrative functions on behalf of State courts. As such, the County does not maintain, operate, or possess a "correctional/detention facility," as stated in your request. Correctional services in Delaware are within the purview of the State's Department of Correction.
For the foregoing reason, the County does not have within its custody any contract/agreement for inmate communication services, as stated in your request. Please contact the State of Delaware Department of Correction (DOC) for further assistance in this matter.
Please make note of this response so as to avoid any future erroneously directed requests. The County appreciates your cooperation in this matter.
Finally, as a matter of clarification, the County has no record of your purported records request of March 14, 2021. Your request of April 7, 2021, however, was received after business hours by the Sheriff's Office via facsimile and forwarded to my office for response. Per County policy, all records request should be submitted directly to this office for processing and to avoid any lapse in communication.
