Pursuant to the Massachusetts Public Records Law, M.G.L. c.66, ยง10, I hereby request the following records:

Pursuant to Massachusetts General Law Chapter 66, Section 10, I'm requesting all executive session minutes generated, by the Board of Selectmen for the years 2010 through the of end 2015.
Massachusetts law requires that executive session minutes be reviewed and released regularly, and that once the stated purpose for a particular executive session has ended, the minutes of the executive sessions are to be made public.
Please be advised that denial of this request, or redactions made to released materials must be accompanied by citations of the exemptions you believe allow you to withhold the information requested.

I also request that, if appropriate, fees be waived as we believe this request is in the public interest, as suggested but not stipulated by the recommendations of the Massachusetts Supervisor of Public Records. The requested documents will be made available to the general public free of charge as part of the public information service at MuckRock.com, processed by a representative of the news media/press and is made in the process of news gathering and not for commercial usage.

I expect the request to be filled in an accessible format, including for screen readers, which provide text-to-speech for persons unable to read print. Files that are not accessible to screen readers include, for example, .pdf image files as well as physical documents.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

I am in receipt of your email correspondence dated October 25, 2016, requesting "all executive session minutes generated by the Board of Selectmen ("The Board") for the years 2010 through the end of 2015." Initially, your request was sent to a staff member in the Department of Public Works, and was forwarded to me on October 26, 2016. This response shall serve as confirmation of your request.

Since there is no way to contact you by telephone to fully discuss your request, I will attempt to let you know where I am in the process of filling your request with this email. Town Counsel, William Solomon, has reviewed requested minutes and is updating that review to the current date. The Board's next regularly scheduled meeting will be held on November 15, 2016. At that meeting, Town Counsel will be seeking the Board's approval of his determination as to which documents/information may and will be withheld from disclosure based on a reason set out in the Open Meeting Law, such as whether disclosure would defeat the lawful purpose of the executive session, pursuant to an exemption under applicable law or attorney-client privilege. At or before that time, the issue of the cost, to copy and/or scan the documents being provided will be addressed, and I will provided that information to you immediately thereafter. I will provide the released documents to you after the Board's meeting and your determination, based on the cost for the provision of the documents/information consistent with the Open Meeting Law and any other applicable law, as to this office fulfilling your request.

Dear Ms. Russell:

As a follow-up to my email of November 4, 2016, regarding your company's request for "all executive session minutes generated by the Board of Selectmen ("The Board") from the years 2010 through the end of 2015," the cost for copies of the executive session minutes not subject to continued non-disclosure under the provisions of the Open Meeting Law and other applicable law will be under ten dollars ($10). The cost for "segregation time" for the executive session minutes from January 1, 2010 through June 30, 2010 is de minimus and, as such, will not be required in this limited instance.

Please let me know if you would like to receive copies of those executive session minutes (those not subject to continued non-disclosure) and we can arrange to supply them to you. Please note that executive session minutes through the middle of 2014, are paper records and would be provided as such.
