Pursuant to the Missouri Sunshine Law and the Missouri Public Records Law, I hereby request the following records:

Computer-aided-dispatch (CAD) logs for the St. Louis County Police Department, for August 9, 2014, from 11am until midnight.

I also request that, if appropriate, fees be waived as I believe this request is in the public interest. The requested documents will be made available to the general public free of charge as part of the public information service at MuckRock.com, processed by a representative of the news media/press and is made in the process of news gathering and not for commercial usage.

In the event that fees cannot be waived, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 3 business days, as the statute requires.

The request was made on behalf of Freedom of the Press Foundation, a 501(c)3 non-profit organization working to preserve and strengthen the rights guaranteed to the press under the First Amendment: https://pressfreedomfoundation.org/.

I request a waiver of search, review, and duplication fees on the grounds that disclosure of the requested records is in the public interest because it "is likely to contribute significantly to public understanding of the operations or activities of the government and is not primarily in the commercial interest of the requester." 5 U.S.C. 552(a)(4)(A)(ii); 22 C.F.R. 171.17(a); see also 28 C.F.R. 16.11(k)(1).

I also request a waiver of search and review fees on the grounds that Freedom of the Press Foundation qualifies as a "representative of the news media" and the records are not sought for commercial use. 5 U.S.C. 552(a)(4)(A)(ii); 28 C.F.R. 16.11(d).

Accordingly, fees associated with the processing of the request should be "limited to reasonable standard charges for document duplication." 5 U.S.C. 552(a)(4)(A)(ii)(II); see also 22 C.F.R. 171.15(c); 28 C.F.R. 16.11(d) (search and review fees shall not be charged to "representatives of the news media").

Freedom of the Press Foundation meets the statutory and regulatory definitions of a "representative of the news media" because it is an "entity that gathers information of potential interest to a segment of the public, uses its editorial skills to turn the raw materials info a distinct work, and distributes that work to an audience." 5 U.S.C. 552(a)(4)(A)(ii); see also Nat'l Security Archive v. Dept of Defense, 880 F.2d 1381 (D.C. Cir. 1989).
