Dear Lt. Pearson,

Thank you for your prompt response.

If I'm understanding your response correctly it appears as if you would like to charge fees for this request under section 610.026.1(2), which is reserved for public records that require special handling and training for duplication beyond merely locating and copying a copying a record, simply because I've requested an electronic copy.

To clarify, I'm seeking regular copies of proposals distributed by REJIS including service for "license plate recognition (ALPR) - BOSS server setup" from 1/1/2013-8/1/2017 -- and merely asking that the staff member responsible for copying these records use the "Email" or "Send" function of your office's copy machine rather than the "Print" function. Because of this, I believe that the records I'm searching for should instead be subject to fees under Section 610.026.1(1), that is no more than 10 cents per page for standard paper copies, and the average hourly rate of pay for clerical staff to duplicate documents. As you are no doubt aware, this provision also requires that the public governmental body use the lowest salaried employees capable of searching, researching, and copying the records.

In the event that you still believe that you are subject to fees under section 610.026.1(2), I believe that your office is improperly calculating those fees, as you misquote the law which requires that this fee "shall not exceed the average hourly rate of pay for staff of the public governmental body required for making copies" -- and while I understand that REJIS does pay competitive wages, I find it hard to believe that the hourly rate of pay for staff required for making copies is in fact $86.04.

Finally, in the event that you still believe that this request is subject to fees under section 610.026.1(2) at an hourly rate of $86.04 simply because I've requested copies electronically, I respectfully request an estimate for the same request to be printed and mailed, or to be viewed in person at your office during an appropriate time.

1. These proposals are printed and sent to and received from LEAs throughout the region. Yes?
2. Your estimated fee for fulfilling this request electronically was $172.08. What is the estimated fee if they were requested as standard paper copies?

Good Morning,

I'm not clear on your first question but to provide insight, I'll explain part of the proposal process. There are no templates. Our proposals are sight (agency) specific. After meeting with the agency, understanding their wants/needs, we write a proposals. This proposal takes into account the size of the agency, their use of the information, storage of that information (data)....to include purge cycles, what equipment is needed to make it all happen, enabling connectivity, creating interfaces with existing/new equipment, hard/software and a host of other considerations. There are no two agencies that are exactly the same. At times we may even embed our own IT personnel within the agency to get things up and running.

Region.....We do extend throughout most of Missouri however, not all. Additionally, we have a few clients in Illinois and parts of Kansas.

Standard copy paper will be an additional .10 per copy with approximately ...........30 - 35 copies (again, approximately).

Attached please find a sample of the documents I'm seeking. I'm not seeking any additional documentation beyond this two page form that have been generated for the agencies that you collaborate with.

I believe this to be a simple request, and as the records appear to be standard paper copies I again, respectfully request that fees be estimated and calculated using the fee schedule in RSMO 610.026.1(1) & not 610.026.1(2).

If it would be easier for your agency to supply me with *all* of the proposals distributed by REJIS from 1/1/2013-8/1/2017 instead of the subset above, I would be more than happy to sift through them on my end. I don't wish to burden you and the important work you engage in more than necessary.

Again....unfortunately, we have to physically look through all of our client documents to see which agencies requested such a proposal (regardless of the type) during the specified time frame. We do not have our files categorized by request type or just the dates, it's by client.

Some clients may have all the infrastructure in place so the proposals are two pages, other may not, requiring additional items and the proposal consists of several pages.

Believe me, we wish that we had a clerk assigned to us, but unfortunately we don't.

I totally get it. And I have no objection to you all being compensated accordingly for your time. All that I'm asking is that the request's fees be estimated and calculated according to RSMO 610.026.1(1) & not 610.026.1(2).

Put simply -- instead of y'all charging me the "average rate of pay for the bodies' staff" I believe the law requires that I'm entitled to the records at the rate of "the lowest salaried employees capable of searching, researching, and copying the records" which I'm assuming is less than $86.04 hourly.
