In an October, 2014, [letter to Justin Glawe][1], Rory O'Sullivan, assistant city counselor at City of St. Louis Metropolitan Police Department, wrote, "Your request, dated September 24, 2014, for records related to Kajieme Powell, has been forwarded to me for a response. [...] It is our understanding that the investigation is still active and a threat assessment has concluded that releasing the names of the officers at this time would pose a danger to their safety."

Pursuant to the Missouri Sunshine Law and the Missouri Public Records Law, I hereby request the assessment of potential threat of publicly revealing the names of the police officer(s) who committed homicide of Kajieme Antoine Powell in St. Louis, Missouri, on August 19, 2014, that Rory O'Sullivan referenced in the letter to Justin Gawe, along with associated metadata.

I also request that, if appropriate, fees be waived as I believe this request is in the public interest. The requested documents will be made available to the general public free of charge as part of the public information service at MuckRock.com, processed by a representative of the news media/press and is made in the process of news gathering and not for commercial usage.

In the event that fees cannot be waived, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 3 business days, as the statute requires.

Thank you for responding, after 16 months of delay, to my request for the assessment of potential threat of publicly revealing the names of the police officer(s) who committed homicide of Kajieme Antoine Powell in St. Louis, Missouri, on August 19, 2014, that Rory O'Sullivan referenced in the letter to Justin Gawe, along with associated metadata.

You demanded that I remit a fee of $6.50 in order to receive an electronic copy of this long-overdue record, but you did not state any justification for such. It seems you could simply have attached a file to your e-mail and press 'send', incurring no expense for materials or shipping and about ten seconds of labor. Could you please explain the fee?

$6.50 is the standard charge for reports. We waived charges of $44.00/hour in attorney time to review the threat assessment and redact closed record information under Revised Missouri Statutes Section 610.100.
