A recent appellate court decision, SEIU Healthcare 775 NW v. DSHS, 193 Wn. App. 377 (2016) holds that when an agency receives a request for documents that includes a list of individuals, the agency is required to determine whether the list will be used for “commercial purposes.”  The case concluded that a requestor has a commercial purpose if the requestor intends to use the list for direct or indirect profit making activity, regardless of whether the requestor intends to contact the individuals on the list or even if the individuals are personally affected by the release of the list or not.  If the County has some indication that a requestor intends to use a list of individuals for a commercial purpose, we are required to “investigate further” before we disclose that list. Further, the SEIU case held that an affirmation stating that any records containing lists of individuals obtained for a public records request will not be used for commercial purposes is not sufficient.
Instead, before we can release records which include a list of individuals, we are required to obtain from you sufficient details as to what you intend to use the list for so that we can make an independent evaluation as to whether or not your purpose is commercial or not.
We are bound in making our determination by SEIU Healthcare 775NW v. DSHS, 193 Wn. App. 377 (2016).  There, DSHS was asked for records, which it intended to release. It was sued by a union that objected to the release. DSHS claimed that it had an affirmation from the requestor that the records were not going to be used for commercial purposes.  The following was the Court’s answer:

a. DSHS suggests that if an agency has an obligation to investigate, an affirmation from the requesting party that the intended use of the list is not for commercial purposes is sufficient. The problem with such an affirmation is that it allows the requesting party to control whether a list of individuals will be released without any independent inquiry by the agency. Therefore, merely requiring an affirmation from the requesting party is not sufficient to satisfy an agency's obligation to investigate under RCW 42.56.070(9). When under the specific case facts an agency has an obligation to investigate, it must at least require a party requesting a list of individuals to state the purpose of the request. Such a requirement is permissible under RCW 42.56.080, and it would allow the agency to independently evaluate whether the requesting party's purpose is a commercial one.

In this regard, please fill out and return Spokane County’s Commercial Purpose Declaration, attached hereto. A determination will then be made as to whether your stated purpose regarding the use of the lists of individuals contained in any compiled responsive records is sufficient to allow for the release of this information.
To avoid unnecessary delay in obtaining these specific responsive records for your request, please return the completed declaration at your earliest opportunity. We will follow up with you within five business days as to the validity of the stated purpose relating to your request. In the alternative, if you are amenable to receiving a copy of the document that does not include the portions that contain names of individuals we will forward you that version of the document as soon as it is available.
Please provide the completed and signed Commercial Purpose declaration, or in the alternative, confirm that you wish to have a copy of the document with the portion containing the names of individuals removed, within 30 days of today’s date. If, by that date, we have not received a completed and signed Commercial Purpose Declaration, or confirmation that you are amenable to receiving a copy of the document with the names of individuals removed, your public records request will be considered abandoned and will be closed.
