Pursuant to the Washington Public Records Act, I hereby request the following records:

Any and all statistics, data, reports, audits, policies, and procedures pertaining to the following items regarding sexual assault evidence collection (SAEC) kits (also known as "rape kits") and processing:

• all standard operating procedures regarding the SAEC process

• any written policies or procedures regarding department practices on the acquisition of or handling of rape kit evidence, including protocols for its collection, testing, and delegation and transfer to all other possibly relevant locations, laboratories, or agencies

• the number of kits collected and booked into evidence from the period of January 1, 2000 through the date this request is processed

• the number of kits that have been processed by a public or private crime or forensic laboratory or equivalent processing location from the period of January 1, 2000 through the date this request is processed

• the number of unprocessed kits in any storage facilities currently under the department’s jurisdiction and control, including those held by medical personnel or at external laboratory locations

• any materials regarding the status or ultimate disposition of cases in which a kit was collected. Please include all available segregable data.

• all audits involving this agency regarding the collection or backlog of SAEC kits

• all proposed alterations or yet-to-be-implemented changes to the policies and procedures regarding the collection, testing, and use of SAEC kits

This is to acknowledge your below March 16, 2018, public records request directed to the Spokane Police Department. Your request was forwarded by Spokane Police Records staff to the City Clerk’s Office for response and was received by the City Clerk’s Office on March 26.

This is to advise that I anticipate providing you with a next installment of records on or about Tuesday, May 29, and will follow up with you accordingly.

I am still in the process of working with staff from the Spokane Police Department in locating and compiling additional records for your request. Due to other work obligations and staff schedules, I anticipate requiring an additional 30 days, or until June 25, to conclude your request.

This is a follow up to my previous correspondence regarding your March 16, 2018, public records request, wherein you state the following:

Portions of your request are phrased in the form of requests for information rather than identifiable public records. However, your request was reviewed by staff from the Spokane Police Department to determine what responsive records for your request could be located. This is to advise that I will be placing in the mail today a compact disc containing the documents SPD were able to locate and compile in response to your request. Portions of your request seek records for the period of January 1, 2000, through the date of your request. Staff compiled records for as far back as responsive records/data were available.

Some information in the records provided were determined to contain information exempt from disclosure and that information has been redacted. An exemption is included on the CD which identifies the redacted information and the reasons for and statutes relied upon for withholding the information.

In accordance with Section 6.5 of the City’s Public Records Request policy, if you wish to appeal a determination to withhold information, you may petition in writing or by email to the City Clerk’s Office for a review of the determination within sixty (60) days of the denial of access. Please include a copy of, or reasonably identify, the part of the response to which you object. Your petition will be forwarded to the Hearing Examiner, who will consider the petition and either affirm or reverse the determination within ten (10) business days following the City’s receipt of the petition, or within such greater period of time as the City and the requestor mutually agree to. You may obtain a court review of the denial of your request pursuant to RCW 42.56.520 at the conclusion of the two business days after the initial denial, regardless of any internal administrative review. Upon your review of the provided documents, if you are seeking additional records from the City, and/or if you have specific knowledge of any responsive records in the City’s possession that have not yet been made available to you, please clarify your request by clearly describing what the remaining identifiable public records are that you may still be attempting to seek, and we will continue to look into your request for you.

Please provide any such clarification within 30 days of today’s date, or by July 30. If no clarification is received from you by that date, your March 16, 2018, public records request will be considered concluded and closed, and a new request would be required in this matter after July 30.

The City’s charge for the CD and postage is $4.56 (27 cents for the CD + 7 cents for the CD sleeve + 72 cents for the mailing envelope + $3.50 postage). Please remit a check or money order in the amount of $4.56, payable to the City of Spokane, to my attention at the following address: Office of the City Clerk, Fifth Floor of City Hall, 808 West Spokane Falls Boulevard, Spokane, Washington 99201.
