Good afternoon:

In follow up to my May 3 correspondence to you regarding your public records request assigned tracking number P004290-072621, this is to inform you that an installment is available by accessing your account via the My Request Center on the GovQA portal.  The installment is comprised of  records located by Internal Affairs staff from the Spokane Police Department.

Some information in the provided records was determined to be exempt from disclosure and has been redacted.  Exemption logs accompany the reports which identify the redacted information and the reasons for and statutes relied upon for withholding the information.

In accordance with Section 6.5 of the City’s Public Records Request policy, if you wish to appeal a determination to withhold information, you may petition in writing or by email to the City Clerk’s Office for a review of the determination within sixty (60) days of the denial of access.  Please include a copy of, or reasonably identify, the part of the response to which you object.  Your petition will be forwarded to the Hearing Examiner, who will consider the petition and either affirm or reverse the determination within ten (10) business days following the City’s receipt of the petition, or within such greater period of time as the City and the requestor mutually agree to. You may obtain a court review of the denial of your request pursuant to RCW 42.56.520 at the conclusion of the two business days after the initial denial, regardless of any internal administrative review.  The complete Public Records Request Policy may be accessed at the following website:  https://my.spokanecity.org/administrative/public-records/.

Due to other workload and staff schedules, I anticipate a next installment will be available in approximately 30 days, or on or about June 26, and I will follow up with you accordingly.  If a next installment becomes available in advance of that date, I will let you know.  Likewise, if more time is required, I will advise as such.

A portion of your request states the following:
Please include all information or procedures which landed him on the Brady list and all communication through writing, email, post it notes or recordings discussing his behavior

Regarding your reference to " . . . the Brady list . . .,"  I am still in the process of determining what responsive records may be located for this portion of your request, although, to the best of my knowledge, the City of Spokane/Spokane Police Department does not maintain a "Brady List."   However, it is our understanding that the Spokane County Prosecuting Attorney's Office may maintain such a document.  If you have not already, you may wish to make a separate request of the County to determine what responsive records that agency may hold in this regard.  The contact information for making a request of the County is as follows:

Tony Dinaro, Public Records Officer
