Materials related to this agency's acquisition of, access to, preservation of, or disclosure of automated license plate readers (ALPR) or ALPR data:

1. Policies related to the adoption of ALPR technology, including those guiding the procurement process or necessary administrative obligations before acquisition.

2. Training policies, requirements, and materials for automatic license plate reader system operators.

3. Databases used to compare data obtained by the automatic license plate reader system.

4. Policies related to the retention and security of captured ALPR data, including those regarding:
- the length of time after capture that data may be preserved
- exceptions to general data preservation policies
- internal data security and access
- data destruction

5. Policies related to the sharing of captured ALPR data by this agency with other agencies, including those directing:
- the manner in which another agency may request data
- the circumstances under which captured data may be shared, and
- the responsibilities of the recipient agency in regards to data retention and use.

It is our understanding from Police Department staff that SPD does not operate their own ALPR system but utilizes the City of Post Falls Police Department system.  See OPR 2018-0165, the City's Personal Services Agreement with the City of Post Falls, which is available by accessing your account through the City's online public records request portal, GovQA.
Regarding Item No. 3 of your request, the requested data is retrieved from WACIC/NCIC (ACCESS) which is a secure law enforcement database and is restricted to law enforcement use pursuant to Federal law.  The non-disclosure of such information is essential for effective law enforcement.  The information is exempt from disclosure pursuant to 28 U.S.C. § 534; 28 CFR 20.38; and RCW 42.56.240 (1) (Investigative, law enforcement and crime victims).
In accordance with Section 6.5 of the City’s Public Records Request policy, if you wish to appeal a determination to withhold information, you may petition in writing or by email to the City Clerk’s Office for a review of the determination within sixty (60) days of the denial of access.  Please include a copy of, or reasonably identify, the part of the response to which you object.  Your petition will be forwarded to the Hearing Examiner, who will consider the petition and either affirm or reverse the determination within ten (10) business days following the City’s receipt of the petition, or within such greater period of time as the City and the requestor mutually agree to. You may obtain a court review of the denial of your request pursuant to RCW 42.56.520 at the conclusion of the two business days after the initial denial, regardless of any internal administrative review.  The complete Public Records Request Policy may be accessed at the following website:  https://my.spokanecity.org/administrative/public-records/.
