In accordance with the Public Records Act (PRA), RCW 42.56.520, this message acknowledges receipt of your two PRA requests, received by the City of Spokane on July 28, 2021, pertaining to Kyle Kozza (Koza).  These requests have been assigned tracking numbers P004353-072821 and P004355-072821.  Please use these numbers in any communications concerning this request.

Our procedure is to locate records, review them for exemptions, and then prepare them for your inspection and/or copying.  The undersigned will be coordinating with other City departments in the collection and production of responsive records.

Your request has been forwarded to staff in the City's Police Department for review and compiling of any responsive records.  We reasonably anticipate requiring approximately one week or until on or about August 12, 2021, to make an installment of records available to you.  We will follow up with you on or about that date regarding the status of your request.  If public records become available in advance of this estimate, we will let you know.  Conversely, if City staff encounters a need to extend our estimate, we will advise accordingly.

This is a follow up to my August 5, 2021, message to you pertaining to your public records requests assigned tracking numbers P004353-072821 and P004355-072821.   A responsive record to your request is available for your review by accessing your "My Request Center" account on the City's public records request portal (GovQA).  You will note upon review that the document contains some redactions.  An exemption log accompanies the document explaining the withheld information and the reasons and statutes relied upon for withholding the information.

In accordance with Section 6.5 of the City’s Public Records Request policy, if you wish to appeal a determination to withhold information, you may petition in writing or by email to the City Clerk’s Office for a review of the determination within sixty (60) days of the denial of access.  Please include a copy of, or reasonably identify, the part of the response to which you object.  Your petition will be forwarded to the Hearing Examiner, who will consider the petition and either affirm or reverse the determination within ten (10) business days following the City’s receipt of the petition, or within such greater period of time as the City and the requestor mutually agree to. You may obtain a court review of the denial of your request pursuant to RCW 42.56.520 at the conclusion of the two business days after the initial denial, regardless of any internal administrative review.  The complete Public Records Request Policy may be accessed at the following website:  https://my.spokanecity.org/administrative/public-records/.

Police Records Unit staff have advised that no records were located under the names "Kozza" or "Coza."  In addition, Police Records Unit staff have advised that Spokane County Sheriff's Office and Kalispel Tribal Police have also had arrest contacts with Kyle Koza.  You may wish to make a public records request of those respective agencies for a determination as to what, if any, records those agencies may hold.  To make a request of Spokane County, visit the the County's public records request portal by clicking here or visit Spokane County's website at the following link: https://www.spokanecounty.org/.   To make a request of the Kalispel Tribal Police, you may wish to visit their website at the following link:  https://kalispeltribe.com/our-government/public-safety/.

A portion of your requests state "any and all communications or contacts or meetings or notes..."  Does the provided incident report address these portions of your requests or did you intend for an email search to be performed of the City's Enterprise Vault System (email storage system)?  We also note that no time frame is provided under your requests.  If you intended an email search to be performed, what is the time frame under which you would like us to search?  Please advise and clarify.  Please clarify this portion of your request within 30 days of today's date or by September 13, 2021.  If no such clarification is received by that date, we will consider this portion of your request concluded and closed.

I am in the process of following up with Police Records Unit staff as to whether any remaining records have been located.  I anticipate requiring until on or about September 13 to provide a next installment of records, if any, to your request and/or to provide a status update regarding your request.

This is a follow up to my August 5, 2021, message to you pertaining to your public records requests assigned P004353-072821 and P004355-072821. Your request assigned P004353-072821 references "audio" and your request assigned P004355-072821 references "communications or contacts...recorded." By this, we are unclear if you are seeking body camera video.  Police Department staff have advised there is body camera video associated with incident 2019-20213574, which was previously made available to you as part of my August 5 response.   Do you wish to obtain the body camera video?  If so, there will be charges associated with redacting the bodycam video.  The fee is $0.39/minute redaction fee in accordance with RCW 42.56.240(14).   You may view information on the City's redaction fee on the City's website at the following link: https://my.spokanecity.org/administrative/public-records/.
Please advise by September 13 as to whether you wish to proceed with obtaining body camera video.  If you require an estimate as to the cost associated with redacting the body camera, please advise and I will work with Police staff on an estimate.
Also, by September 13, please provide the requested clarification as sought under My August 5 response as to whether you wish an email search to be performed, and if so, what is the time frame under which you wish us to search.
If you have specific knowledge of any remaining records that have not yet been made available to you under your request, other than those referenced above for which we await clarification from you, please advise and clarify with as much specificity as you can as to what those remaining records are that you seek, and we will be glad to look into your request further.
If no such clarifications are received as requested above and as requested under my August 5 response to you, we will consider your requests (P004353-072821 and P004355-072821) abandoned and will subsequently close them; and a new request for any remaining records you may be seeking will need to be made after that date.
