Pursuant to the South Carolina Public Records Law, I hereby request the following records:

Written protocols for carrying out an execution by firing squad at at Broad River Correctional Institution.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 15 business days, as the statute requires.

The South Carolina Freedom of Information Act enumerates several matters which are exempt from disclosure pursuant to the Act or are excluded from the Act’s definition of a public record. All the records which you have requested in FOIA request 0098-22 are subject to one of these exemptions or exclusions. Specifically, the records you have requested are exempt or excluded based on the below listed sections of the FOIA statute. Because all the records you have requested are unavailable under FOIA, FOIA request 0098-22 is now closed. If you choose to modify and resubmit your request, it will be treated as a new request and assigned a new request number.

Applicable exemptions and exclusions:
S.C. Code § 30-4-20(c) Security plans and devices are specifically excluded from the definition of the term “public record” (See also Judge Lee’s Nov 25, 2020 order in Justice 360 v. SCDC & Stirling, 2020-CP-40-05306).
