Pursuant to the South Carolina Public Records Law, I hereby request the following records:

1) All current policies and procedures regarding medical and room & board costs or fees for which incarcerated youth (i.e. juvenile) and/or their parents or legal guardians are or may become liable. Please include all policies and procedures related to how fees are set, accrued, imposed, collected, and enforced (such as those related to per diem fees, ability to pay determinations, penalties for late or non-payment, authorization for civil or criminal action for payment enforcement, etc).

2) All reports, databases, spreadsheets, or equivalent materials regarding debts/restitution paid to or owed to this department/office or any facility/agency under its jurisdiction in FY2021. Please include all relevant data regarding medical and room & board costs, including the number of youths (i.e., juveniles) charged for medical and room & board costs or fees and the total amount of medical and room & board fees imposed in FY2021.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Good morning, Mr. Salisbury,

On March 31, 2023, The Department received a request from you pursuant to the South Carolina Freedom of Act (FOIA) for certain information pertaining to SC Youth Pay to Stay Policy. Pursuant to South Carolina Code Sections 63-19-2010 and -2020, juvenile records are confidential and can only be released in certain circumstances.

Currently, the Department is in the process of assessing agency records to determine what records, if any, are in the Department's possession that would be responsive to your request. The Department's fee schedule regarding record production is as follows:

Copies 1-25 pages = No charge.
Copies over 25 pages = $.20 per page.
Search/retrieval fee = No fee if documents are readily available. $20 per hour after the first 30 minutes.
Scanning/Redaction fee = $20 per hour after the first 30 minutes.
Postage = if the cost exceeds the standard USPS first class postage stamp, postage must be paid in advance, or you may make arrangements to pick the records up in person at 220 Executive Center Drive, Columbia, South Carolina 29210.

Generally, record requests take approximately thirty days; however, the actual processing time will depend on the complexity of your request and whether or not it involves sensitive or voluminous records, or extensive searches and/or consultations. Please note that personally identifiable juvenile information of youth other than your client will be redacted from any releasable documents, as youth records are confidential and subject to release only pursuant to a Court Order or other exceptions which are not applicable here (South Carolina Code Ann. ยง63-19-2010 and -2020).

Once the Department has gathered the information which is producible and responsive to your request, we will send an email to inform you of the cost, if any, of the redaction and copying of the documents. We will produce these records electronically, unless paper copies are preferred. In the meantime, please do not hesitate to reach out to me if you have any additional questions.

In response to your FOIA request received by the Department on March 31, 2023, the Department has no responsive documents. However, I would direct you to S.C. Code Section 63-19-360 which sets forth the institutional services provided by SCDJJ. In addition, S.C. Code Section 63-19-410 states the fees that may be charged by the Department for services. Please note that the Department does not charge youth or their families housing fees.

Further, S.C. Code Section 63-19-1410(A)(3) allows the Family Court to order restitution in juvenile matters and sets forth the factors the Court must consider when determining the amount of restitution ordered. Currently, the Department is not receiving restitution for any of its youth.
