I also have another request that you sent through muckruck that seems duplicative of your past FOIAs, but I haven’t had an opportunity to pull those files and compare them. South Carolina is a party to the tobacco Master Settlement Agreement (MSA) entered into between the major tobacco companies and 52 Settling States (46 States, DC, Puerto Rico, and four territories) in 1998. As part of the ongoing obligations under the MSA, the State AG Offices are in continued contact with Phillip Morris USA and its parent company, Altria. You’ve asked for communication with Altria client Services. Can you confirm that the MSA notices are not the types of communications you are requesting? Many of these documents are subject to confidentiality provisions of the MSA.

Andrew,

Hunton & Williams represents a company our Consumer Protection Division has sued. The case involves underground storage tanks (fuel tanks I believe). There are email communications with opposing counsel at Hunton & Williams that involve settlement negotiations. There is a court protective order in place, but I have not reviewed the order to determine whether the documents would be protected from disclosure. Can I exclude these documents by agreement?
