Pursuant to the South Carolina Freedom of Information Act, I hereby request the following records:

-The current memorandum of agreement (MOA) or memorandum of understanding (MOU) with the Defense Logistics Agency, Disposition Services regarding the 1033 equipment surplus program administered by the DLA Law Enforcement Support Office

-The annual inventory form required to be completed by the state coordinator of the 1033 program

According to the DLA FAQ page regarding the 1033 program, the General Services Division is the agency in charge of coordinating the 1033 program for South Carolina. See http://www.dispositionservices.dla.mil/leso/Pages/StateCoordinatorList.aspx

I also request that, if appropriate, fees be waived as I believe this request is in the public interest. The requested documents will be made available to the general public free of charge as part of the public information service at MuckRock.com, processed by a representative of the news media/press and is made in the process of news gathering and not for commercial usage.

In the event that fees cannot be waived, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Attached you will find documents you requested under the Freedom of Information Act pertaining to South Carolina state government's participation in the Law Enforcement Support program (AKA program 1033). I have enclosed the current Memorandum of Understanding (with an addendum) between the Defense Logistics Agency (DLS) and the SC Budget and Control Board's General Services Division, which, as you note in your request, is the state government entity which coordinates the 1033 program.

In your request you ask for an “annual inventory form” required to be completed by the state coordinator of the 1033 program. We are unable to identify the document which you are seeking, however the Accountability Letter may be to what you are referring. I have attached it as well, dated from 2012. Since then, this inventory process has required staff to fill out a form online, resulting in a certification emailed to the state coordinator of the 1033 program. I have attached the current certification.

Section 30-2-50 of the Code of Laws of the State of South Carolina provides that no person or private entity shall knowingly obtain or use any personal information obtained from a public body for any commercial solicitation directed to a person in this State. The South Carolina Budget and Control Board, as a public entity, gives notice to you , as a requestor of records from this agency, that obtaining or using these public records for commercial solicitation is prohibited. Any person who knowingly uses public records for commercial solicitation is guilty of a misdemeanor and, upon conviction, must be fined an amount not to exceed five hundred dollars or imprisoned for a term not to exceed one year, or both. Please see S.C. Code of Laws Section 30-2-10, et. seq. for a full text of the Family Privacy Protection Act.

Hello,

Thank you for sending the MOA. More than twenty-five states have all released nearly identical spreadsheets which they indicated were compiled, reviewed or at least downloaded in completing state coordinator duties -- many of these spreadsheets were called "property book" or something similar. I've attached three such spreadsheets here.

I've requested here the corresponding spreadsheet for South Carolina within GSD's possession. Please confirm whether such a spreadsheet exists?

Attached with this email is the list of materials distributed to South Carolina law enforcement agencies through the Defense Logistics Agency's (DLA's) 1033 program, as requested under the Freedom of Information Act.
The Law Enforcement Support Office (LESO) originated from the National Defense Authorization Act <http://www.dispositionservices.dla.mil/leso/Documents/LESO%20Forms/FY1997NDAA.pdf> which provides for the transfer of surplus US Department of Defense property to law enforcement agencies across the country. In South Carolina, the Budget and Control Board's General Services Division coordinates the 1033 program. Board personnel manage only the transfer of this property. Law enforcement agencies receiving it must comply with DLA regulations addressing the manner in which the materials are stored, distributed, and used.
