Pursuant to the state Freedom of Information Act, G.L.M. c.66, §10, we hereby request the following records:

Please provide
1. a full listing of any paid City of Somerville Staff who also hold "ex officio" voting membership on any of the City of Somerville's Boards, Commissions and Authorities; and,
2. A listing of any and all 2012 City of Somerville Boards, Commissions and Authorities that can include, as stipulated by city ordinance, municipal paid staff acting as "ex officio" voting members within that municipal body.

We also request that, if appropriate, fees be waived as we believe this request is in the public interest, as suggested but not stipulated by the recommendations of the Massachusetts Supervisor of Public Records. The requested documents will be made available to the general public free of charge as part of the public information service at MuckRock.com, processed by a representative of the news media/press and is made in the process of news gathering and not for commercial usage.

I am writing in response to your two requests for information, received in this Office on August 21, 2012.

I have conducted a diligent search of the records of the City Clerk’s Office. I have not found a full listing of any paid City of Somerville staff who also hold "ex officio" voting membership on any of the City of Somerville's Boards, Commissions and Authorities. In addition, I have not found a listing of any and all 2012 City of Somerville Boards, Commissions and Authorities that can include, as stipulated by city ordinance, municipal paid staff acting as "ex officio" voting members within that municipal body.

In an attempt to reasonably comply with what I believe is the intention of your request, I have provided a spreadsheet I have developed that, to the best of my knowledge, lists the paid City of Somerville staff who are also “ex officio” members of the City’s Boards, Commissions and Authorities. I have attached this spreadsheet in both .pdf and .xls formats.

There will be expense involved to fully comply with your requests, so I am providing this written estimate of costs. The cost is $393.48, which consists of 12 hours of my time to research the enabling legislation for each of the City’s Boards, Commissions and Authorities, and determine which ex officio positions are held by paid City of Somerville staff.

Upon receipt of $393.48 by cash, check, or money order, I will produce the information you request. Because I will be on vacation until September 4, 2012, I request that you allow me until September 14, 2012 to comply.

Thank you very much for your timely response to the request for information regarding which of the City's Boards, Commissions and Authorities have ex officio positions held by paid City of Somerville staff!

Although your research to respond to the second part of this request is well worth the amount you are reasonably charging for it, $393.48, CAPS cannot pay for this portion of the request at this time.

Therefore, please consider this email a formal withdrawal of that portion of the public records request.
