From: Tom Nash

To Whom It May Concern:

Pursuant to the Massachusetts Public Records Law, M.G.L. c.66, ยง10, I hereby request the following records:

Records of overtime pay sorted by employee and salary sorted by employee (exclusive of overtime) for 2012-2013, in Excel or similar spreadsheet format.

I also request that, if appropriate, fees be waived as we believe this request is in the public interest, as suggested but not stipulated by the recommendations of the Massachusetts Supervisor of Public Records. The requested documents will be made available to the general public free of charge as part of the public information service at MuckRock.com, processed by a representative of the news media/press and is made in the process of news gathering and not for commercial usage.

I expect the request to be filled in an accessible format, including for screen readers, which provide text-to-speech for persons unable to read print. Files that are not accessible to screen readers include, for example, .pdf image files as well as physical documents.

In the event that fees cannot be waived, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 10 business days, as the statute requires.

Sincerely,

Tom Nash

Good afternoon Mr. Nash,

Please be advised that the police department does not have a document prepared that meets your specific request. The salary information requested is included in an annual document that is released to the public by other city officials. There is no year to date document that currently exists. All of this information requested does exist within the payroll system, but would require that a document specific to this request be created, most likely from the Payroll Office at City Hall.

I hope that this response is helpful.

Dear Mr. Nash: You have requested the following from the Somerville Police Department. "Records of overtime pay sorted by employee and salary sorted by employee (exclusive of overtime) for 2012-2013, in Excel or similar spreadsheet format." I am informed that there is no document that fully responds to your request. Below please find links to the City of Somerville FY 2012 and FY 2013 budget. I refer you to pages 175 through 178 of the FY12 Budget, pages 128 through 131 of the FY13 Budget and FY14 includes July 1 - December 31, 2013, I have also included the FY 14 Budget, see pages 156 through 160.

I am informed the documentation you have requested exists within the payroll system as to individual employees, but would require a search thereof, printing same and a review for any required redactions. If you would like a good faith estimate of the cost to produce those documents, please let me know. Thank you.

Mr. Nash: I am in receipt of your email, below. I have requested the good faith estimate from the Payroll supervisor. She is out of the office until September 4th. Thereafter I anticipate she will respond to my request in the regular course of business. Once received, this office will forward that information to you. Thank you.

From: Frank Wright

Dear Mr. Nash:

This letter acknowledges receipt of your email dated August 26, 2013, requesting a good faith estimate to provide the requested records of overtime pay sorted by employee and salary sorted by employee (exclusive of overtime) for 2012-2013.

The estimated fee to comply with your request for copies of these records is $780.00. I am informed the lowest paid employee capable of searching, segregating and compiling the requested records is the Payroll Manager, who has an hourly rate is $32.50. Her good faith estimate is that it will take 24 hours to complete this task.

The actual cost of producing the records may vary. Upon receipt of the estimated fee, the city will commence providing the requested public records and shall withhold or redact any record or portion thereof to the extent provided by law, specifying the applicable exemption(s).

Should you wish to receive this documentation please forward a check to my attention in the amount of $780.00 made payable to the "City of Somerville." Thank you.

Hello,

This fee estimate sounds incredibly excessive, as other departments have been able to comply with this request for as little as $35.00.

To be clear, we are asking for a copy of payroll for the requested years, broken down by salary and by overtime pay.

Does this affect the estimate in any way?

Thank you.
