Pursuant to the Massachusetts Public Records Law, M.G.L. c.66, §10, I hereby request the following records:

Any documents detailing a security presence in public elementary, middle and high schools, including documents regarding police tactics in public schools and records of arrests/citations given to students

I also request that, if appropriate, fees be waived as we believe this request is in the public interest, as suggested but not stipulated by the recommendations of the Massachusetts Supervisor of Public Records. The requested documents will be made available to the general public free of charge as part of the public information service at MuckRock.com, processed by a representative of the news media/press and is made in the process of news gathering and not for commercial usage.

I expect the request to be filled in an accessible format, including for screen readers, which provide text-to-speech for persons unable to read print. Files that are not accessible to screen readers include, for example, .pdf image files as well as physical documents.

In the event that fees cannot be waived, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Dear Mr. Craven:

This letter is in response to your e-mail and public records request dated July 8, 2013. After review of your request, I am providing you with the following response based each part of your request.

Your request seeks “documents detailing a security presence in public elementary, middle and high schools in Somerville…” This office has identified approximately 9 pages of records which are responsive to your request. Those records will be provided upon receipt of a check payable to the City of Somerville in the amount of $1.80. Please mail that check to the Somerville Police Department, Records Bureau, 220 Washington Street, Somerville, MA 02143.

Additional responsive documents have been identified by both the police department and school departments containing school emergency plans and police department operational plans and policies. These records will not be provided and are withheld in accordance with the following exemptions to the Massachusetts Public Records Law: G. L. c. 4, § 7(26)(b) and G. L. c. 4, § 7 (26)(n). Exemption (b) applies to documents “related solely to internal personnel rules and practices of the government unit, provided however, that such records shall be withheld only to the extent that proper performance of necessary governmental functions requires such withholding”. In this case, police policies and operational plans are documents which relate to the use of personnel and practice in certain circumstances in order to maintain security in the event of certain emergencies. Exemption (n) applies to records which relate to “…security measures, emergency preparedness, threat or vulnerability assessments, or any other records relating to the security or safety of persons or buildings, structures, facilities, etc.”, for which the disclosure “is likely to jeopardize public safety”. In the reasonable judgment of the records custodian, the disclosure of such records would impact public safety of persons and/or the school buildings and properties referenced in your request.

The last part of your request seeks “any records of arrests/citations given to students”. The Records Custodian is unable to determine the type of record sought with respect to this portion of your request. Violators and offenders are not recorded by their student affiliation. It is unclear as to what students, location, or time period the request relates to. In addition, the term “citations” is not clear. Please provide a reasonable description of the requested records and a further response will be provided.
