The first email exchange involving the City Solicitor's office concerning the review of commissions starting in early 2012 that was mentioned by then-mayoral spokesman Tom Champion in the May 2012 SJ article titled "Somerville commission accuses City Hall of retaliation".

I also request that, if appropriate, fees be waived as we believe this request is in the public interest, as suggested but not stipulated by the recommendations of the Massachusetts Supervisor of Public Records. The requested documents will be made available to the general public free of charge as part of the public information service at MuckRock.com, processed by a representative of the news media/press and is made in the process of news gathering and not for commercial usage.

I expect the request to be filled in an accessible format, including for screen readers, which provide text-to-speech for persons unable to read print. Files that are not accessible to screen readers include, for example, .pdf image files as well as physical documents.

In the event that fees cannot be waived, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

This letter is in further response to your public records request dated July 23, 2013. After review of your request, below is an estimate of the applicable fees to respond to your request.

Based on your request and e-mail of July 26, 2013, the search parameters to locate the responsive record, if any, containing the “first email exchange involving the City Solicitor's office concerning the review of commissions starting in early 2012” would be as follows: (1) e-mail to or from the City Solicitor, and (2) containing the word “commission” and/or “board”, and (3) during the period between January 1, 2012 and May 17, 2012 (date of newspaper article you reference). The earliest responsive record would be identified based on the search results. If you would like for city staff to commence the search and obtain any responsive copies, please send a check to my attention payable to the City of Somerville in the amount of the total estimated fee. Thanks for your response. Are those the criteria that you and the City Solicitor feel is most likely to find the responsive record?

I am only interested in the earliest resulting record if it clearly indicates that the alleged commission review was being planned and/or executed, is that clear?

Perhaps the formatting has obscured the cost calculation: does it show that the costs include 1 hour of IT time for $31.66 + 0.1 hour of your time ($38.46/hr) = $31.66 + $3.84 = $35.50 ? If so, why would it take so much IT time to conduct the search?
