Pursuant to the California Public Records Act, I hereby request the following records:

1. The total number of use of force incidents, broken down by type of force used, from 2013-2018 (separated by year).
2. The total number of use of force complaints reported to the sheriff’s department and (separately) the total number of use of force complaints that were sustained from 2013-2018 (separated by year).
3. The current sheriff’s deputies union contract
4. The current sheriff’s department policy manual

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

This is to provide a response to your request dated November 21, 2019, which the Shasta County Sheriff’s Office received via email the same date. The California Public Records Act requires a response to your request within ten days of receipt of your request. However, pursuant to subdivision (c) of section 6253 of the Government Code, you are hereby advised that it will be necessary to extend that time period for 14 days from the date of this letter. The extension is necessary in order to have sufficient time to properly process your request.

If we determine we have responsive records that are not exempt from disclosure, you will be advised of the costs of duplication, if any, and the records will be made available to you. This is to respond to your Public Records Act request dated November 21, 2019 that the Shasta County Sheriff’s Office received by email on the same date. Although your email references an October 26, 2019 request, we have no record of receiving it.

Your request seeks four items. The current union contract and department policy manual which were requested as items three and four are attached.

Item one requests the total number of use of force incidents, broken down by type of force used, from 2013-2018. The Sheriff’s Office is not in possession of a document that tracks or lists all use of force incidents. If you believe that the Sheriff’s Office may have records which you are interested in requesting regarding “use of force incidents” or complaints, please contact me and identify what particular records you would like to request.

As to item two, based on our understanding of the term “use of force complaints,” the total number of use of force complaints reported to the Sheriff’s Office from 2013-2018 is nine. The total number of use of force complaints sustained from 2013-2018 is zero. The complaints were reported as follows: one in 2015; two in 2016; five in 2017; and one in 2018.
