Pursuant to the New York Freedom of Information Law, I hereby request the following records:

By way of background, on August 10, 2022, Governor Kathy Hochul signed into law Chapter 490 of the Laws of 2022 requiring a survey regarding instruction on the Holocaust within New York State public school districts. Through the survey, superintendents are required to attest that the district is teaching about the Holocaust appropriately as part of classroom instruction aligned with the NYS Social Studies Learning Standards and §801 of Education Law.

In October 2022, Deputy Commissioner Angelique Johnson-Dingle sent a memo to public school superintendents including a copy of that survey and instructions for accessing and submitting the survey via the SED Monitoring and Vendor Performance System in the NYSED Business Portal.

Pursuant to the New York Freedom of Information Law, I hereby request all of the Holocaust Instruction Survey responses submitted since August 10, 2022.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

FOIL. Please be advised, the District does not respond to email requests
for FOIL information via drop box or portals. Our Data Privacy policies do
not allow the district to click on links that are suspicious or otherwise
not determined to be legitimate to protect the integrity of school district
data. We also do not respond to FOIL requests without a contact name AND
telephone number for the individual receiving the information, in order to
determine the point of contact receiving such records. Accordingly, this
particular request for information under FOIL is denied. If you would like

I am writing to appeal the denial of my Freedom of Information Law (FOIL) request for the Sharon Springs Central School District's Holocaust Instruction Survey responses. I received a response stating that the district does not respond to FOIL requests via email and that my request was denied due to a lack of contact information. I would like to provide my contact information now and request that my FOIL request be reconsidered.

As per my original request, I am requesting all Holocaust Instruction Survey responses submitted since August 10, 2022. My request was made in accordance with the New York Freedom of Information Law, which grants the public the right to access government records. Specifically, FOIL requires that agencies respond to requests in writing within five business days, and that they provide the records unless they fall under one of the statutory exemptions.

Moreover, FOIL regulations state that agencies should accept requests via any medium, including email, unless doing so would interfere with the operation of the agency's IT system or pose a threat to data security. As a result, the district's claim that they do not respond to FOIL requests via email is not supported by the law.

I understand that the district has an obligation to protect sensitive information, but there is no evidence that my request would compromise the security of the district's data. In fact, I requested that the documents be provided in electronic format, which would not require the district to disclose any personal information or access to any internal systems.

In addition, the Committee on Open Government has issued several advisory opinions stating that agencies may not require requesters to provide personal information or fill out forms as a precondition for granting access to records. Accordingly, the district's demand for a contact name, address, and telephone number is not supported by the law.

I respectfully request that the district comply with my original FOIL request and provide me with the Holocaust Instruction Survey responses submitted since August 10, 2022. If the district continues to deny my request, I ask that you provide me with a detailed explanation of the basis for the denial and the specific legal authority for withholding the records.

Your initial requests was denied because it required the District to open
up a drop box link and submit documents online. The districts data
protection policies prohibit our users from opening links that are unknown
to the district. Your portal is not a known portal.

In the reply to your FOIL request, you were asked for information so that
the district can accommodate your FOIL requests in a format other than an
online drop box. A simple telephone conversation with our records access
officer could easily resolve any questions regarding the method in which we
can accommodate your FOIL request. Please feel free to contact our School
Business Official and Records Access Officer at adipace@sharonsprings.org,
or 518-284-2266.

Alternatively, the district can mail a copy of the information requested in
the FOIL to your address listed in your email. The cost per page is $.25.
Mr DiPace estimates there are 3 pages of information in the request, for a

However, FOIL explicitly states that agencies may not charge for the cost of staff time or use of equipment, and may only charge for actual photocopying or mailing costs. The requirement to print out documents that are already in electronic format and the demand for payment are an attempt to extort FOIL requestors for funds that are not required to fulfill the response.

I respectfully request that the district comply with my original FOIL request and provide me with the Holocaust Instruction Survey responses submitted since August 10, 2022, in electronic format via email or CD-ROM. If the district continues to deny my request, I ask that you provide me with a detailed explanation of the basis for the denial and the specific legal authority for withholding the records.

Furthermore, I would like to remind the district that continued willful avoidance of complying with FOIL laws will result in appeals to the Committee on Open Government and may result in Article 78 proceedings at the district's expense. Please be advised that a copy of this appeal will also be sent to the Committee on Open Government for their review.

Sharon Springs is a small school with limited technological and Human
Resources. This particular report is not already in electronic form that
is accessible to you. It is online in the State Portal. In order to
provide this report to you, it has to be printed off and then converted to
PDF format.

We have not denied your request. Instead we are attempting to provide the
documentation you have requested in an acceptable format. That requires
printing, and photocopying, whether we create a CD ROM or simply provide
you with the printed version or create a PDF for you. By school district
policy, our charge is 25 cents per page.

Your request has been approved. Please let us know how you would like to

Hi,

While we value your links to school districts that have complied with your
request, Sharon Springs operational capabilities and interpretation of FOIL
is not conditioned on that of other organizations. As you are aware, the
State allows for a charge of 25 cents per page AND a fee for the actual
costs of reproducing a record especially when more than 2 hours are
necessary to complete the task.

In relation to this particular request I have instructed Anthony DiPace to
create a PDF copy of this report by accessing the State Department of
Education portal and “printing” off the report you are requesting. Upon
printing, the district will convert the document by “scanning” it to a PDF
that can be provided to you. Please be advised, the document you requested
does not currently exist in an electronic format, this is the reason we
believe charges are appropriate.

Mr. DiPace will send your document to you along with an invoice for any
charges we deem appropriate, so as to not delay release of the information.
You should expect to hear from him within the next 24 hours.

Thank you for your response to my previous appeal regarding my Freedom of Information Law (FOIL) request for the Sharon Springs Central School District's Holocaust Instruction Survey responses. While I appreciate your efforts to provide the requested documents, I respectfully disagree with your assessment that a charge is appropriate in this case.

The New York Freedom of Information Law specifies that agencies may only charge for actual reproduction costs, and that such costs may not include labor or other indirect costs. In addition, the Committee on Open Government has issued several advisory opinions stating that agencies may not charge for electronic copies if they are readily available in electronic form.

I understand that the district may not have the resources to create electronic copies of the requested documents, but I would like to point out that there are many free tools and resources available for generating PDF files in various operating systems and browsers, many are installed by default in software already installed in district computers. Providing the requested documents in electronic form would not only save the district time and resources, but would also be more convenient and accessible for requestors.

Moreover, I must express my disappointment in the district's handling of this matter thus far. It is my understanding that several other school districts have been able to easily comply with similar FOIL requests, and that the use of online portals and electronic delivery is becoming increasingly common in government agencies. I urge the district to take a proactive approach to complying with FOIL and to make every effort to provide requested documents in a timely and accessible manner.

I respectfully request that the district reconsider its decision to charge for the requested documents and provide them to me in electronic form as soon as possible. If the district continues to deny my request or requires payment beyond the actual reproduction costs, I will have no choice but to appeal to the Committee on Open Government and pursue legal action if necessary.

PS: I also respectfully suggest that the district consider providing training and education to staff and administrators on the generation of PDF files and other electronic document formats to avoid the need for printing and scanning in the future. This could not only save time and resources, but also ensure compliance with FOIL and other state and federal laws regarding open government and transparency.

The question is not the ease in which a pdf document can be created, or whether the district has the ability and expertise to do so; you have answered the real question in your most recent email: “the Committee on Open Government has issued several advisory opinions stating that agencies may not charge for electronic copies if they are readily available in electronic form.” As we have told you in our previous emails, this document is not available in electronic form- in order to provide it electronically we have to create it. The very fact that you ask for an estimate of costs with each of the FOIL requests in your name on behalf of Mucrock is certainly an acknowledgment that you understand that documents not readily available electronically could be accompanied by costs. In many cases, if we can accommodate requests simply, we waive charges associated with simple FOIL requests, but we do attempt recoup costs incurred as we feel it is our responsibility to our public school district.

Accordingly, let me express my disappointment in the way you have responded to this matter as well. We do not take your accusations of “extortion” and “willful attempt to deny” lightly. They are unprofessional and uncalled for, especially when we have only been trying to accommodate your request in an acceptable manner. The simple courteousness of a phone call could have cleared this matter up in moments. I would certainly recommend that you refrain from unfounded accusations.

I will fulfill your request within 24 hours. Should we determine that a charge is warranted we will send an invoice, not to exceed $.75.

First, I apologize if my language in previous emails was unprofessional or uncalled for. However, I stand by my assertion that the district's initial response to my FOIL request was in violation of FOIL regulations, and that the district's insistence on charging for electronic copies of the documents was not supported by the law.

Second, I would like to draw your attention to the fact that there are 17 FOIL requests on behalf of MuckRock that have been ignored or refused by Sharon Springs Central School District. I believe that this pattern of behavior demonstrates a disregard for the public's right to access government records and a failure to comply with FOIL regulations.

Dear Mr. Parker,

Attached you will find a copy of “Public Records” in relation to the
Holocaust Survey, as per your request. I am sending them to you at this
email address as per your latest request, despite the footer notes in your
standard email that states “improperly addressed (i.e., with the
requester's name rather than "MuckRock News" and the department number)
requests might be returned as undeliverable”. This is our concern
regarding email requests and fulfillment of requests as we cannot determine
with certainty whether emails have ever been received or sent.

In regards to the 17 requests you mentioned in your response, it should be
noted that all have been responded to and no appeals have been filed. Only
4 of these requests remain within the 30 day appeal window. Also, each
response has included an invitation to discuss and reconsider your request,
rather than a complete denial. Each of these requests have come from
Jackson Parker, under a separate email address, with unvetted links
included in the email. We have repeatedly advised you that we do not
respond to FOIL requests via drop box. Many of your emails have been
caught by our SPAM filter because of the content and links within the
email. We strongly recommend that you remove the links included in your
emails to ensure that the request makes it to the Public Records Access
Office. If we don’t receive your email, we cannot process it. We also
recommend that a single email address be used for your requests to avoid
confusion. Lastly, many of your requests are not specific enough in nature
and do not define the specific records that you are requesting. This is
why we ask for personal contact information such as a telephone number so
that we can properly process your request without denying it on the basis
of misunderstanding regarding the public records you may be requesting.
Sharon Springs processes FOIL requests regularly, and we have often help
resolve and or clarify requests. We have no intentions of willful
disregard for access to public records as you suggest in your email.

This document had to be created from a public data base and the typical
charge for this would be $.25 per page, for a total of $.75. Given the
nature of this request, we are waiving the fee for this particular
request. However, we reserve the right to charge fees on any future
requests in order to offset costs to the District associated with future
requests when appropriate. If you should have any questions, as always-
