Pursuant to RCW Ch. 42.56 (Public Records Act), I hereby request the following records:
All information collected by MailChimp about City Council email subscribers. This is in reference to a January 5 message with the subject "Important Notice to Seattle City Council Email Subscribers - 2nd Courtesy Notice", which stated:
"Email distribution services will be provided by a new third party, MailChimp. Their privacy policy may be viewed here: http://mailchimp.com/legal/privacy/. Please note that information provided by subscribers, including link activity, will be used to improve the effectiveness of our notification processes. We will not rent or sell your subscription information; however it may be subject to disclosure under Revised Code of Washington 42.56."
The requested documents will be made available to the general public, and this request is not being made for commercial purposes.
In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.
Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 5 business days, as the statute requires.

In accordance with RCW 42.56.520, this e-mail formally acknowledges receipt of your Public Records Request dated January 6, 2015 and addressed to Nancy Craver with a Cc: to Councilmembers and received by the Legislative Department same date regarding:

Could you please clarify if you are seeking just the fields that are collected by MailChimp or the actual data in MailChimp. Once we receive your clarification we will be better able to provide you with an estimated time frame it will take to gather the records, review them for responsiveness and provide them to you.

Thank you for the clarification. We anticipate providing you with an installment of records on or before February 26th. In addition, since the records you request will contain a list of names, per RCW 42.56.070(9) we will need you to sign an affidavit certifying the list of names will not be used for commercial purposes. A scanned copy will be adequate.

Thank you for the update!
I have no commercial interest in the records, but as the response to this request is going to be made public, I cannot certify that they won't be used commercially by some other party. If an affidavit annotated to that effect is acceptable:

Since all paperwork is posted on the muckrock site, it would include the affidavit you sign which would notify anyone seeing the records that they cannot be used for commercial purposes. This should adequately cover that clause. Please let me know if you require an additional copy of the affidavit.
