From: Clark, Jennifer

Dear Mr. Mocek:

This concerns your public disclosure request dated October 17, 2015, requesting Mutual Aid feedback regarding May Day 2015.

In an effort to reduce the SPD Public Disclosure Unit's backlog that has resulted from an unprecedented increase in the volume and complexity of PRA requests SPD has received in the past year, we have distributed requests among SPD staff who do not normally respond to requests. Thus, the Legal Unit will be responding to #P2015-6169.

While the due date currently assigned to the request was 3/16/16, we will not be able to provide you the response until April 14, 2016. I apologize for any inconvenience that this may cause you.

Let me know if you have any questions or concerns.

Thank you,

Hello Mr. Mocek,

The purpose of this email is to provide you with the records responsive to your PDR (P2015-6169) for the Mutual Aid feedback regarding May Day 2015. Attached, please find the following records responsive to your request to include two emails from mutual aid partners: Bellevue PD AAR Comments and Valley CDU AAR Comments.

Pursuant to RCW 42.56, the following redactions have been applied:

Bellevue PD AAR Comments:

· Intelligence Information: (page 1) - Specific intelligence information which is essential to effective law enforcement is not disclosable. RCW 42.56.240(1) and/or RCW 43.43.856. Explanation: Disclosure would reveal law enforcement techniques, capabilities, limitations, and the extent of law enforcement knowledge which would jeopardize investigations/prosecutions and/or assist individuals in criminal activity.

You received the May Day 2015 AAR in your PDR (P2015-5186). There are mutual records/comments within that report. Would you like me to resend the AAR? If so, please provide me with a mailing address (along with $1.60 copying/mailing fee); the AAR is too large to send via email.

This correspondence closes your PDR. If you have any questions, please do not hesitate to contact me.

Kind regards,
Katie

From: Phil Mocek

Dear Ms. Berger,

I reiterate my October request for Mutual aid feedback regarding May Day 2015. I did not in this request ask for any summaries thereof or after-action reports. Am I to understand that you have, in response to P2015-6169, filed by me more than six months ago, provided all responsive records?

Cordially,
Phil Mocek

From: Berger, Katelyn

Mr. Mocek,

All mutual aid feedback was provided to you via email sent to you yesterday except for the mutual aid feedback found in the After Action Report (AAR). You have already been provided the AAR in a previous PDR. My question to you was simply if you would like another copy of the AAR since it is responsive to this request.

Katie Berger
SPD Legal Unit Manager

From: Phil Mocek

Ms. Berger,

Thank you for clarifying. If the AAR was received by SPD as feedback from mutual aid partners, then I do, indeed, expect a copy of it in response to my request for mutual aid feedback. If, however, the AAR contains copies or excerpts of mutual aid feedback received, I request that feedback, as provided by mutual aid partners, not as filtered through the author(s) of the AAR. My suspicion is that records responsive to this request are comprised of e-mail and letters from outside agencies, not a report authored by your agency.

Cordially,
Phil Mocek

From: Berger, Katelyn

Mr. Mocek,

Do you want to pick-up the AAR at SPD Headquarters? Or would you like me to mail it to you? If you want it mailed, please provide me with a mailing address.

Regards,
Katie

From: Phil Mocek

Ms. Berger,

The AAR is, as I understand it, a report authored by one or more of your colleagues, not feedback from staff of mutual aid partner agencies received by your agency.

I reiterate my request, now more than six months old, for mutual aid feedback received. If it is unclear what records are responsive to this request, perhaps you will want to inquire with the author of the October draft of your May Day 2015 report which references said feedback.

Cordially,
Phil Mocek

From: Berger, Katelyn

Mr. Mocek,

I understood first clarification of your request you provided, below. There are emails from our mutual aid partners inserted in the AAR. Therefore, the AAR is responsive to your request.

As stated below, the AAR is too large to send via email. How would you like delivery; either U.S. Mail or pick-up at SPD Headquarters? Please advise.

Regards,
Katie

Ms. Berger,

Please provide electronic records in their native electronic format. I do not want e-mails, letters, or any other records compiled into a report; I want the original records.

Cordially,
Phil Mocek
