I appeal. I believe, based on Ms. Glundeberg-Prossor's statements to me, that your search was inadequate.

In your response of April 6, 2021, you wrote to me that a "comprehensive search of [your] department resulted in no responsive documents," and you informed me that you consider the request closed.

I don't know what you meant by a search of your department. I would not expect you to question each person who is currently or formerly assigned to work as part of Seattle IT (i.e., your department) for responsive records. I assume that given the current pandemic, your physical office is empty, and I don't expect you to go downtown and search through desks and cabinets in your office (i.e., your department) for responsive records. I believe that most or all public records to which Seattle IT Department staff have access are digital in nature, are stored on various machines that are not in your office, and are available via remote electronic access.

I fear that a search "of your department" may be inadequate for the discovery and retrieval of electronic records.

It is my understanding that your department administers the e-mail server(s) on which email messages for mailboxes in the seattle.gov domain are stored. My request is specific to records for mailbox karen.haverkate@seattle.gov. Did your search include a query to that or those servers? If not, I request that you perform such a search for records responsive to my request by querying the mail server on which seattle.gov mailboxes' messages are stored. I expect that with an e-mail address and keyword, an administrator of said server could have results in a matter of seconds.

Further, I know based on the result of a past public records request that your department administers the city's mailing list management system, an installation of LISTSERV running on the machine known as talk2.seattle.gov. On October 14, 2015, I requested of Seattle IT Department the index of mailing lists hosted on that system. You, personally, responded in the context of processing that request. It had dragged on for nearly a year when on August 5, 2016, you wrote that "[your] team executed the `Lists Detailed' command in the manner requested in [my] attached appeal letter." On August 26, 2016, you wrote that you, along with then-IT-director Michael Mattmiller, had "ran the specific command per [my] instructions." To this day, an interface to that mailing list management system is available at <http://talk2.seattle.gov/>.

Based on my decades-long familiarity with various mailing list management systems, and on my understanding that staff at your department are designated as administrators of the City of Seattle LISTSERV, I believe that you or your staff can query LISTSERV on talk2.seattle.gov for messages from karen.haverkate@seattle.gov to fitlist@talk2.seattle.gov. Please do so.

I am writing in response to the April 26, 2021 appeal you filed for Public Records Request C072697-040521. Specifically, you are appealing whether Seattle Information Technology (ITD) conducted an adequate search before closing your request and referring it to the Seattle Police Department (SPD) for processing on April 6, 2021.
When the City conducts searches for emails, each department is quarantined off from other departments. These compliance barriers are set up because certain departments maintain information that may require certain levels of security. Thus, each department owns and is responsible for its own content and responds to requests for that content accordingly. In response to your request, ITD ran an email search and that search did not return responsive records.
ITD does provide and maintain a technology infrastructure on which city departments conduct their business. However, the individual departments own and remain the subject matter experts of the records housed on those systems, with the personnel possessing the appropriate training and backgrounding to respond to requests for records owned and created by their respective department. For your request, SPD is the department with the appropriate staff, access, and expertise to provide a complete and accurate response to your request. Recognizing this, ITD asked SPD to open a case for you, and SPD did so on April 13, 2021 under P073109-041321. The City of Seattle will respond to your request under P073109-041321. Therefore, this completes ITD’s response to your request.
It would be most efficient to direct further communications about your request to the SPD public disclosure officer managing P073109-041321 through GovQA, as we have previously suggested.
