Pursuant to RCW Ch. 42.56 (Public Records Act), I hereby request the following records:

I would like data on every citation issued to a non-motorized bicyclist for "driving under the influence" between May 2010 to present. If possible, I would prefer this data be arranged on an Excel spreadsheet or in CSV form, and to include the time and location of the citation. Additional details regarding the citations would also be welcome in a separate document or documents, which could include all relevant write-ups in PDF form.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 5 business days, as the statute requires.

I am writing in response to your requests for Seattle Municipal Court Records dated June 23, 2016, June 30, 2016 and July 6, 2016 all of which were received by the Court on July 11, 2016.

The Seattle Municipal Court provides records in accordance with Washington State Court Rules and Seattle Municipal Court Policy. For more information, please visit: http://www.seattle.gov/courts/pio/piohome.htm.

The Washington State Public Records Act, RCW 42.56, does not apply to courts, as they are not agencies as defined in the Act. This has been affirmed most recently by the Supreme Court of Washington in their 2009 decision in City of Federal Way v. Koenig, 217 P. 3d 1172.

The Seattle Municipal Court is a limited jurisdiction court with jurisdiction over certain violations of Seattle Municipal Code. The Court does not have a violation code relating to a charge of driving under the influence for a non-motorized bicyclist. Thus, we have no records/or data for cases or citations issued for this violation.
