Please provide the standard form (if any) your agency provides to subjects SMPD officers suspect are under the influence of alcohol and/or a drug. If there are separate forms please provide each.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 10 calendar days, as the statute requires.

Good Morning,

I received the attached request last Wednesday, July 3, 2019 and need some clarification as to what information you are seeking. You ask for "...the standard form (if any) your agency provides to subjects SMPD Officers suspect are under the influence..." There is a standard form the California Department of Motor Vehicles (DMV) requires the Officer fill out and submit to them when there in an under the influence arrest. The subject arrested is provided with 1 of the pages of this form as required by the DMV, this become their temporary license for 30 days. Could this be the form you are seeking a copy of? This form is referred to as the Admin Per Se. Otherwise, there is nothing that we provide the subject, a report is written and submitted to court for review and prosecution.

Thank you for your reply.

To clarify, this request seeks a copy of the blood-draw refusal admonition (verbatim language) SMPD officers are required to provide to subjects suspected of a DUI/ DUI Drug offense, per departmental policy, beginning January 1, 2017 through the present date.

If the form to which you refer in your previous correspondence is DMV – Form DS 367, please indicate so, and provide a copy of the form(s), including any modification in the refusal admonition language, for the above-reference time period.
