Pursuant to the California Public Records Act, I hereby request the following records:
1. all press releases re: Isaiah Peoples (the "Defendant") and the alleged April 23 multiple attempted murder in Sunnyvale (the "Incident")
2. all photographs of the Incident or Defendant
3. all 911 calls of the Incident
4. all on-scene videos incl. body cam footage of the Incident
5. all witness reports of the Incident
6. all other public records or information requests (formal or informal) made to your agency by anyone else (including media), AND the responses you have given them, re: the Incident or the Defendant. Please remember your exemption-waiver requirements under Govt Code 6254.5 - if you have provided it to other public/media, we expect you to provide it to us as well.
7. all incident reports or arrest reports of the Incident or Defendant
8. all criminal complaints filed against Defendant
9. every document, notice, motion, or filing (incl. all exhibits, appendices, and attachments) filed by your office in any court case against the Defendant
10. all other available documents re: the Incident or the Defendant

Given the extremely high public interest in this incident, please waive fees and provide a response as soon as possible, and please provide responsive records on a rolling basis as you approve/redact them for disclosure.
If you do not waive fees, please send only those records available without any fees - since we have asked for electronic copies, we expect all will be available without fees. Nevertheless, for any records for which you would charge fees, instead of copies, please provide us the (free) statutorily-mandated CPRA determination of what records exist, so we may inspect them in person if we so choose to do so, and notify us of the expected costs if we wished to move forward with copies.

I would prefer the request fulfilled electronically, by e-mail attachments, if possible.

For all electronic copies, you have an obligation to provide electronic records in the original format you hold them.

Please consider your obligations under City of San Jose v. Superior Court (Smith), S218066 to search personal accounts/devices storing public records -- which we do explicitly request.

Please cite statutory authority for any records withheld in whole or in part.
If you withhold certain records at this time as part of a pending law enforcement investigation, we may continue to followup re-requesting the records in the future.

We intend to repeat this request periodically to receive more up to date information as time goes on.

I write to provide a follow-up response to your May 1, 2019 CPRA request to the County of Santa Clara’s Office of the District Attorney. We previously provided an initial response on May 13, 2019.

The Office of the District Attorney has no responsive records for Item 1 of your request. Items 2, 3, 4, 5, and 7 seek law enforcement records that are exempt from disclosure under Government Code section 6254(f), or are not in the possession of the Office of the District Attorney. However, we did obtain a disclosable record in response to Item 3 from the County 9-1-1 Communications department, which is attached. We previously provided the only public record responsive to Items 8 and 9. For Item 9, we have withheld court records that were filed under seal, and therefore cannot be publicly disclosed. (See Gov. Code, § 6254(k).) We are continuing to review records that may be responsive to Items 6 and 10. We will produce any responsive and disclosable records, or portions of records, on a rolling basis.
