I’m writing in response to your May 22, 2020 note below in which you state that you previously submitted a records request on April 15, 2020. I’m afraid this is the first time we are seeing any earlier request but I can confirm receipt now. In that request, you seek “electronic copies all of emails sent or received after April 1, 2020 by employees of the Santa Clara County Department of Public Health containing any of” the following: “CalREDIE,” “database,” “data,” “dashboard,” “Microsoft,” and “embed.”

As you know, the County currently is responding to the COVID-19 pandemic, which threatens the health, safety, and welfare of the County’s residents. Collection and review of the records you seek would require the diversion of staff who are essential to the County’s emergency response. Moreover, we anticipate that a number of responsive records would be subject to exemptions. These exemptions include, but are not limited to, records reflecting attorney work product, attorney-client privileged information, or other information exempt from disclosure under federal or state law (Gov. Code, § 6254, subd. (k); Evid. Code, § 954); records that include preliminary drafts (Gov. Code, § 6254, subd. (a)); records that reveal confidential information and the deliberative process involved in County decision-making (Times Mirror Co. v. Super. Ct. (1991) 53 Cal.3d 1325, 1338-39; Cal. First Amend. Coalition v. Super. Ct. (1998) 67 Cal.App.4th 159; Evid. Code, § 1040); and records that include patient health information (Gov. Code, §§ 6254 subd. (c), 6276.34; Health & Saf. Code, § 123135).

Given the ongoing public health emergency, the need to review the requested records for exemptions, and the sensitivity of the content, it is not in the public interest for County employees focused on the County’s crisis response to divert their time to collecting and reviewing records responsive to your request. (Gov. Code, § 6255, subd. (a); City of San Jose v. Superior Court, 2 Cal. 5th 608, 629 (2017) (recognizing burden in processing a California Public Records Act request as a basis for denying request pursuant to Gov. Code, § 6255, subd. (a)); see American Civil Liberties Union Foundation v. Deukmejian, 32 Cal.3d 440, 453 (1982)). Accordingly, the County is not producing any records in response to your request at this time.

If you can amend your request to seek records that would not require the diversion of critical County resources and personnel from the County’s pandemic response, we will review your revised request and evaluate whether we can respond at this time. Otherwise, we will contact you when we can begin producing responsive records on a rolling basis.
