From: Brian Oaster

To Whom It May Concern:

Pursuant to the California Public Records Act, I hereby request the following records:

All archaeological records between 1980 and 1996 pertaining to the properties that are now Calvary Assembly of God church, Alviso Adobe Park, and the surrounding residential subdivision of approximately 16 single family homes. The parcel of interest is bordered to the north by Calaveras Road, to the west by Piedmont Road, to the south by Uridias Road, and to the east by the property lines of the church, Alviso Adobe Park, and the residential property at 2147 Uridias Ranch Rd. Prior to the church and residential development in the late 1980s or early 1990s, this parcel seems to have been one property, and at least one archeological study is supposed to have been conducted around that time which determined the presence of human remains and burial artifacts on site.

Additionally, please include any records showing what has become of any remains or burial artifacts from this site in the event that any have been moved, and what tribal consultation has taken place (if any) regarding the presence of human remains or burial artifacts on site.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 10 calendar days, as the statute requires.

Sincerely,

Brian Oaster

Dear Mr. Oaster,

I am writing regarding your request for information received by The Clerk Recorder's Office on April 22, 2022. Request attached.

* The Clerk Recorder's Office does not maintain Archeological records, artifacts or documents pertaining to burial sites. The Clerk Recorder's Office also oversees the County Archives and I confirmed that they do not have Archeological records or artifacts related to burial sites.

To conduct a search for Official Records on identified addresses, we need to narrow down the scope of this CPRA request. We will need the addresses for:

* Calgary Assembly of God Church, Alviso Adobe Park, and the 16 single-family homes bordering the parcel of interest. Most importantly, we need the address of the parcel of interest.

Once we receive the addresses, we can do a search for Official documents during the timeframe that you have indicated.

Please feel free to contact me for any clarification.

Best Regards,

Genevieve Singh-Hanzlick

Dear Mr. Oaster,

My name is Robert Fannion, Deputy County Counsel for the County of Santa Clara tasked with advising the County's Clerk-Recorder. While Ms. Genevieve Singh-Hanzlick at the Clerk-Recorder's Office has responded to your request under the California Public Records Act (CPRA) with a request for some clarification as to the geographical boundaries of the area after which you are inquiring, the County Counsel's Office has coordinated with the County Department of Planning and Development and the County Department of Parks and Recreation to identify any responsive, non-exempt public County public records. Based on their search, I am able to inform you that the County does not possess records of any archaeological investigation or research between 1980 and 1996 for the area you have described. In an effort to assist you in identifying public records that may be useful to you, the County's Department of Parks and Recreation suggests that you might find responsive records held by the City of Milpitas, as the area you have described lies within the incorporated area of the City of Milpitas (unincorporated County land lies to the north of Calaveras Rd.) and the Alviso Adobe Park is part of the City of Milpitas Recreation Services Department.

Thank you for your inquiry under the CPRA; please let us know if there are any further questions.

Best,

Robert Fannion
