Mr. Perl,
I believe you have misunderstood the request "All email and text communications between County of Marin Employees Deputy Public Administrator Bridget Heffelfinger and Deputy County Adminstrator (sic) Raymond Brady.”I am only requesting emails between those two named government employees - Heffelinger and Brady, within approximate 4 month period. The request is specific and focused. I cannot fathom that you are denying that modest request.

A message was sent to you regarding record request #23-244:
Dear Mr. Powelson,
I did not misunderstand your original request, as it was phrased. It requested "All email and text communications between County of Marin Employees Deputy Public Administrator Bridget Heffelfinger and Deputy County Adminstrator (sic) Raymond Brady," without any time limitation. It appears that you are now narrowing that request, limiting it to a 4-month time period. Although you do not so state, I assume what you mean is that you are now narrowing the request to include only the same period addressed in other portions of the request (January 1, 2023 - April 25, 2023).
Even with the time limitation, the request remains improper under the California Public Records Act (PRA), because it is not sufficiently focused. As noted in my May 1, 2023 correspondence, the PRA does not require producing records in response to unfocused, unspecific requests. “It makes no sense to permit an individual to make a general, unfocused request for records to the public agency. The request to the agency must itself be focused and specific.” (Rogers v. Superior Court (1993) 19 Cal.App.4th 469, 481; see Times Mirror Co. v. Superior Court (1991) 53 Cal.3d 1325, 1345-6.)
As also noted in my May 1, 2023 correspondence, the County has already produced all the requested documents, for the time period January 1, 2023 - April 25, 2023, relating to Richardson Bay Regional Agency, the subject of your request. That would be an appropriate, and sufficiently focused and specific request. Ms. Heffelfinger and Mr. Brady are co-workers in the Marin County Public Administrator's Office. They communicate on a daily basis on all issues related to various Public Administrator matters. Your request for all their communications on all matters is exactly the type of "general, unfocused" and "unspecific" request in response to which public agencies are not required to produce records, and it is unduly burdensome, under the California Supreme Court and California Court of Appeal opinions I have cited. The County of Marin will not produce all email or text communications between Mr. Brady and Ms. Heffelfinger, on all matters.
