To Whom It May Concern:

Attached is a CPRA request for public records directed to Office of the Mayor where "Department Head" is defined as the Mayor.

Your response is required by Dec. 30, 2019. Rolling records responses are requested. Please provide only those records not requiring fees - and a required notice of in-person inspection of fee-based records. We do not want mere URLs; we want exact copies (Gov Code 6253(b)).

We are nw verifying your jurisdiction’s compliance with Knight First Amendment Institute v. Trump, No. 1:17-cv-5205 (S.D.N.Y.), No. 18-1691 (2d Cir.) holding that "the First Amendment does not permit a public official who utilizes a social media account for all manner of official purposes to exclude persons from an otherwise‐open online dialogue because they expressed views with which the official disagrees." You are required to provide the records that exist as of this request. Do not modify your block lists after receipt of this request to avoid providing evidence of non-compliance to us. We will also be verifying that you produce all social media writings as public records pursuant to the CPRA.

NOTE: Please be certain you have properly redacted all of your responses. Once you send them to us, there is no going back. The email address sending this request is a publicly- viewable mailbox. All of your responses (including all responsive records) may be instantly and automatically available to the public online via the MuckRock.com FOIA service used to issue this request and various services that mirror those documents for analysis and research by journalists and the general public (though the requester is an anonymous user, not a representative of MuckRock). Nothing herein is legal, IT, or professional advice of any kind. The author disclaims all warranties, express or implied, including but not limited to all warranties of merchantability or fitness. In no event shall the author be liable for any special, direct, indirect, consequential, or any other damages whatsoever. The digital signature, if any, in this email is not an indication of a binding agreement or offer; it merely authenticates the sender. Please do not include any confidential information, as I intend that these communications with the government all be disclosable public records.

Sincerely,

Anonymous

Hello,

This email serves as the City’s initial response to your request and notification of the need for an extension of time to fully respond, pursuant to Government Code section 6253(c).

It is necessary to search for, collect, and appropriately examine numerous separate and distinct records, in order to gather and review all potentially responsive records; and prepare a comprehensive, coordinated response to your request. Therefore, the City requires an extension of time under Government Code section 6253(c), in order to complete its review of potentially responsive records, compile copies and provide a coordinated, complete response to your request as required by the Public Records Act. We will respond to your request by January 13, 2020.

Please note: City Hall, including the Mayor’s Office, will be closed from December 24, 2019 through January 1, 2020 for the holiday furlough.

Thank you.
Best,

Hello,

City staff has identified and collected the following attached documents that are responsive to #1, #2, #3, #4, #8, & #12 your request.
Please note, Mayor Sam Liccardo only has one Twitter account (@sliccardo). The Mayor did not receive any direct messages from May 9th to May 25th. We have attached a screenshot of his inbox to confirm. Messages outside of this date range have been redacted as they are not responsive to your request.

His account is public. Therefore, all responsive records for #5, #6, #7, #9, #10, & #11 of your request are available publicly on Mayor Sam Liccardo’s Twitter page: https://twitter.com/sliccardo. You do not need a Twitter account to access the requested information.

This concludes the City’s response to your Public Records Act request. Any person who believes that he or she has been inappropriately denied access to City of San José public records, may appeal to the City Council Rules and Open Government Committee.  For more information on the appeals process, see https://www.sanjoseca.gov/your-government/departments-offices/office-of-the-city-manager/official-city-records/appeals.

Thank you.
