Pursuant to the California Public Records Act (California Government Code §§ 6250), I hereby request the following records:

Any database or other records of hate crimes or crimes evidencing bias of race, color, ancestry, ethnicity, religion, gender, gender identity, sexual orientation, national origin or disability reported to or investigated by your agency since Jan. 1, 2010, including where available, but not limited to:

the incident number
date of the incident
whether the crime was against individuals or a business / property
number of victims
race or ethnicity of the victims
gender of the victims
the offense classification
the location of the incident
the bias motivation (anti-black, anti-muslim, etc)

I would like the records in a machine-readable, electronic format if possible. If the records are kept in another format, or kept individually, I would still like copies.

This request is made as part of the Documenting Hate Project, a collaboration involving dozens of news organizations, led by ProPublica. Coverage from the project is compiled at https://projects.propublica.org/graphics/hatecrimes#hatecrime-coverage. This request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

We are able to provide the following information, from July 1, 2012 to present, via query:

· the incident number

· date of the incident

· number of victims

· race or ethnicity of the victims

· gender of the victims

· the offense classification

· the location of the incident

· the bias motivation (anti-black, anti-muslim, etc)

Government Code Subsection 6253.9(b) allows a local government agency to recover “costs of producing a copy of the record, including the cost to construct a record, the cost of programming and computer services necessary to produce a copy of the record” in two situations:

1. In order to comply with the provisions of subdivision (a), the public agency would be required to produce a copy of an electronic record and the record is one that is produced only at otherwise regularly scheduled intervals.

2. The request would require data compilation, extraction, or programming to produce the record.

The current Fee Schedule (http://www.sjpd.org/Records/Fees_Public_Safety.asp) requires $94.00 per hour to cover these costs. The Crime Analysis Unit has provided an estimate of 10 minutes to query either time period mentioned above.

A payment of $15.98 is required to continue processing this request. Payment via check should be made payable to “City of San Jose” and delivered or mailed to my attention at:

Upon receipt of payment, our Crime Analysis Unit will be notified and your request will be placed in the queue for staff to process.

There are existing hate crimes records that are very limited and only contain the incident number and a general bias motivation (i.e. anti-religion, anti-racial, anti-sexual orientation, etc.) I have attached the file which contains information going back to 2011 and is updated through March of this year. Because this is an existing report, there is no charge to receive this.

Please advise if and when you would like to proceed with this request.

Hello,

A payment of $15.98 (check # 1403) was provided to the Research & Development Unit from the Records Unit. The mail was received by the Records Unit on August 15, 2017; however, the enclosed letter was only addressed to “San Jose Police Department.” The Records Unit addresses requests for records (general – copies of reports and specific to PRA requests), so the mail was kept within the Records Unit for processing and later determined to not be related to a request being addressed by the Records Unit.

I understand from previous communication with my Supervisor, Kara Capaldo, that the referenced check may have been cancelled and a new check mailed. Please advise if it is desired to process this payment or if a new payment has been submitted.
