Pursuant to the California Public Records Act, I hereby request the following records:
1. the total number of use of force incidents, separated by year and by type of force used from 2020 (for example, "27 taser incidents in 2019, 3 baton incidents in 2020, etc.)
2. the total number of civilian complaints alleging any form of law enforcement misconduct that were reported and the total number sustained, separated by year from 2019-2020 (for example, 8 complaints in 2019, 2 complaints sustained in 2019, 4 complaints in 2020, 1 complaint sustained in 2020, etc.)
3. the total number of civilian complaints alleging law enforcement use of excessive force that were reported and the total number sustained from 2019-2020, separated by year.
4. the total number of civilian complaints alleging biased policing or racial profiling that were reported and the total number sustained from 2019-2020, separated by year.
5. the total number of civilian complaints alleging criminal conduct that were reported and the total number sustained from 2019-2020, separated by year.
6. all information reported to the FBI’s National Use-of-Force Data Collection program to date.
Note that my requests for civilian complaints are specifically for civilian complaints alleging police misconduct, please do not include complaints filed by one officer/the department against another officer.
The requested documents will be made available to the general public, and this request is not being made for commercial purposes.
In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.
Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 10 calendar days, as the statute requires.

The following publication, an annual report produced by the Independent Police Auditor’s Office, contains responsive information to requests #1 – 5 for calendar year 2019: 2019 IPA Year End Report<https://www.sanjoseca.gov/home/showpublisheddocument/64206/637413097620070000>. The report for calendar year 2020 is expected to be released in August 2021. Additionally, I am awaiting a response from the Department’s Internal Affairs Unit to determine if there are existing records which would contain requested data for 2020 or if the data could be queried from a database.
Additional time is required to address your request. An update will be provided by May 14, 2021.

Please refer to the following information regarding request #1 relating to use of force incidents, provided by the Crime Analysis Unit:
Related information is available on the Department’s website at: https://www.sjpd.org/records/crime-stats-maps/force-analysis-data. The information represented on the dashboard is verified by a third party vendor who has read the police reports and confirmed each of the types of force reported.
Additionally, further data reported by individual officers on a form submitted at the time of report writing is available. However, this information has not been verified for accuracy and may not match what is reviewed online at the provided link for force analysis data. A breakdown for this data does not require a query and can be provided at no charge. The estimated time to produce this information by the Crime Analysis Unit is approximately two weeks. Please advise if this information is desired.
Lastly, information submitted to the FBI National Use of Force Data Collection program is derived from incident reports and manually entered into the FBI website. Refer to the attached record for the event numbers and the accompanying description of the use of force for incident occurring in 2020. Please note OIS = Officer Involved Shooting and SBI = Serious Bodily Injury.
Please refer to the following data regarding requests #2 – 5, provided by the Internal Affairs Unit.

* 2019 – 69 conduct complaints received, of those cases 7 have a disposition of sustained
* 2020 – 103 conduct complaints received, of those cases 78 have been completed, of the completed cases 11 have a disposition of sustained
3. the total number of civilian complaints alleging law enforcement use of excessive force that were reported and the total number sustained from 2019-2020, separated by year.
* 2019 – 47 cases had allegations of Force, of those cases 1 has a disposition of sustained
* 2020 – 62 cases had allegations of Force, of those cases 41 have been completed, of the completed cases 1 has a disposition of sustained
4. the total number of civilian complaints alleging biased policing or racial profiling that were reported and the total number sustained from 2019-2020, separated by year.
* 2019 – 33 cases had allegations of Biased Based Policing, of those cases 24 of them were Biased Based Race or Ethnicity, none of which were sustained
* 2020 – 53 cases had allegations of Biased Based Policing
* of the 53 cases 44 have been completed,
* of the 53 cases 37 are in regards to Race or Ethnicity
* of the 44 completed cases none have a disposition of sustained
5. the total number of civilian complaints alleging criminal conduct that were reported and the total number sustained from 2019-2020, separated by year.
* This information is not tracked in the records management database (IAPro) utilized by the Internal Affairs Unit.
